Abstract

We are immersed in what is considered the fourth -or fifth- industrial revolution, marked by technological advances that are transforming our everyday realities. However, these advances pose a huge challenge for law, which must adapt at a rapid pace. Objects of the highest value, such as data, Big Data and algorithms, are appearing -or reappearing- and the law must find ways to protect them to ensure legal and traffic security because they are traded in the marketplace; and they are some of the most valuable - immaterial - goods, having caused our economy to revolve around them. We must ask ourselves whether the current legal system can meet the challenges that technological advances impose on us and whether it can guarantee secure trading of these new assets.; Estamos inmersos en la que se considera la cuarta -o quinta- revolución industrial, marcada por avances tecnológicos que transforman nuestras realidades cotidianas. Sin embargo, estos avances suponen un reto enorme para el Derecho, que debe adaptarse a un ritmo trepidante. Aparecen -o reaparecen- objetos de altísimo valor, como los datos, macrodatos y algoritmos, y el Derecho debe encontrar formas de protegerlos para garantizar la seguridad jurídica y del tráfico porque con ellos se comercia en el mercado; y son algunos de los bienes -inmateriales- más valiosos, habiendo provocado que nuestra economía gire sobre ellos. Debemos plantearnos si el sistema jurídico actual es capaz de hacer frente a los desafíos que los avances tecnológicos nos imponen y si puede garantizar una negociación segura de estos nuevos activos.
