Abstract

Faced with the “moles” of always interpreting in a restrictive way any limitation to the capacity of people with disabilities, as well as the legal prohibitions imposed on their guardianship or assistance positions, in this work its author proposes its review from a Internationalist interpretation of our norms in combination with «old» principles, updated to new realities, such as the favorabilia amplianda, odiosa restringenda and the in dubio pro capacitate, which do not always necessarily lead to that –intended– restrictive interpretation.; Frente al «topos» de interpretar siempre de forma restrictiva cualquier limitación a la capacidad de las personas con discapacidad, así como de las prohibiciones legales impuestas a sus cargos tutelares o asistenciales, en este trabajo su autor propone su revisión desde una interpretación internacionalista y jurisprudencial de nuestras normas en combinación con “viejos” principios, actualizados a nuevas realidades, como son el favorabilia amplianda, odiosa restringenda y el in dubio pro capacitate, que no siempre conducen necesariamente a aquella –pretendida– interpretación restrictiva.
