El legislador italiano, con la ley 76/2016, ha regulado el contrato de convivencia, instrumento mediante el cual las parejas pueden regular sus relaciones patrimoniales. Sin embargo, la doctrina mayoritaria considera que a las parejas no se les aplican algunas normas que el Código Civil reserva a los cónyuges, entre ellas aquellas relativas a la constitución del denominado “fondo patrimoniale”. Este artículo, a partir del análisis de las razones de la exclusión y de la protección de los acreedores, pone en duda la conclusión a la que llega la doctrina, proponiendo su superación.; The Italian legislator, with Law 76/2016, regulated the cohabitation agreement, an instrument through which cohabiting partners can regulate their mutual property relations. However, the majority of legal scholars believe that certain provisions of the Civil Code that apply to spouses do not apply to cohabiting partners, including those related to the establishment of the so-called “fondo patrimoniale”. This paper, starting from an analysis of the reasons for the exclusion and the protection of creditors, questions the conclusion reached by the doctrine and proposes a way to overcome it.
