Abstract

ESPAÑOL: El presente trabajo se aproxima a los diversos estándares electorales europeos con objeto de efectuar una crítica a maniobras que crean espacios de inmunidad o privilegios políticos, permiten la elusión de responsabilidad penal y distorsionan el juego leal de la democracia representativa. En este sentido, el autor aborda la jurisprudencia tanto del Tribunal Europeo de Derechos Humanos como del Tribunal de Justicia de la Unión Europea en dicho ámbito, así como las sinergias entre ambas jurisdicciones europeas y su impacto a escala nacional. Esas maniobras de dumping electoral son objeto de discernimiento, a través del estudio de la jurisprudencia europea (con algunas referencias asimismo al sistema interamericano de derechos humanos), en relación con otro tipo de movilidad y movimientos en la contienda electoral (personas desplazadas internas o nacionales residentes en el extranjero). Las reflexiones finales apuntan a la necesaria buena fe que ha de impregnar el funcionamiento conjunto del sistema electoral, no solamente a través de exigencias legales que persigan el abuso de derecho y el fraude ley, sino también mediante parámetros morales y éticos (códigos de conducta y buenas prácticas). En suma, la integridad de los procesos electorales pretende consolidar la calidad democrática como imperativo axiológico a escala constitucional y europea. VALENCIÀ: Aquest treball s'aproxima als diversos estàndards electorals europeus per tal de fer una crítica a maniobres que creen espais d'immunitat o privilegis polítics, permeten l'elusió de responsabilitat penal i distorsionen el joc lleial de la democràcia representativa. En aquest sentit, l'autor aborda la jurisprudència tant del Tribunal Europeu de Drets Humans com del Tribunal de Justícia de la Unió Europea en aquest àmbit, així com les sinergies entre les dues jurisdiccions europees i el seu impacte a escala nacional. Aquestes maniobres de dúmping electoral són objecte de discerniment, a través de l'estudi de la jurisprudència europea (amb algunes referències així mateix al sistema interamericà de drets humans), en relació amb un altre tipus de mobilitat i moviments a la contesa electoral (persones desplaçades internes o nacionals residents a l'estranger). Les reflexions finals apunten a la bona fe necessària que ha d'impregnar el funcionament conjunt del sistema electoral, no només a través d'exigències legals que persegueixen l'abús de dret i el frau llei, sinó també mitjançant paràmetres morals i ètics (codis de conducta i bones pràctiques). En suma, la integritat dels processos electorals preten consolidar la qualitat democràtica com a imperatiu axiològic a escala constitucional i europea. ENGLISH: This essay approaches the various European electoral standards with the aim of criticising manoeuvres that create spaces of immunity or political privileges, allow the avoidance of criminal responsibility and distort the fair play of representative democracy. Indeed, the author discusses the case law of both the European Court of Human Rights and the Court of Justice of the European Union in this field, as well as the synergies between the two European jurisdictions and their impact at the national level. These electoral dumping manoeuvres are discerned, through the study of European case-law (with some references also to the Inter- American human rights system), in relation to other types of mobility and movements in the electoral contest (internally displaced persons or nationals residing abroad). The final reflections point to the necessary good faith that must permeate the whole functioning of the electoral system, not only through legal requirements to prosecute abuse of law and fraud, but also through moral and ethical patterns (codes of conduct and good practices). In short, the integrity of electoral processes seeks to consolidate democratic quality as an axiological imperative at both constitutional and European levels.
