La insolvencia de la persona natural es un fenómeno complejo pues debe conjugar los intereses de los acreedores que tratan de cobrar sus créditos y los de los deudores cuyo patrimonio es insuficiente para el pago. En tales casos debe valorarse si el proceso debe conllevar la ejecución de todo el patrimonio embargable del deudor y el alcance de la exoneración de las deudas pendientes de pago a la conclusión del procedimiento, en interés no solo del deudor concursado sino del conjunto de los miembros de su unidad familiar.
