Fundamentalidad y exigibilidad de los derechos sociales: una propuesta argumentativa

Abstract

RESUMEN: La preocupación por encontrar vías de justiacibilidad de los derchos sociales. Ha opacado la discusión sobre su naturaleza y ha dejado la sensación de que la existencia del derecho - bajo la rúbrica de fundamental- depende exclusivamente de justiciabilidad. No obstante, lo que aquí se sostiene es que la justiciabilidad más que una condición ex ante para determinar la exixtencia de un derecho fundamental, es una consecuencia ex post de su fundamentabilidad, de modo que la tarea urgente es hallar "razones válidas y suficientes" para argumentar la fundamentabilidad de los derechos sociales, las que aquí se presentan son: la ampliación del principio de libertad, las necesidades básicas y la dignidad humana y el replanteamiento del principio de igualdad.

ABSTRACT: The concerning of finding routes of justiciability of social rights, has opaque the discussion on its nature and has left the sensation of which the existence of the right -under the heading of fundamental- depends exclusively of its justiciability. However, what is supported here, it is that the justiciability more than an ex ante condition to determine the existence of a fundamental right, it is an ex post consequence of its fundamentality, so that the urgent task is to find "valid and sufficient reasons" to argue the fundamentality of social rights, those that appear here are: the extension of freedom principIe, basic necessities and human dignity and the restatement of equality principle.
