En el contexto del marco normativo español y de la anunciada reducción legal de la jornada máxima de trabajo a 37,5 horas semanales de promedio en cómputo anual, y el debate que ello ha generado, cobra actualidad la interpretación jurídica de Fernando Valdés Dal Ré en esta Sentencia del Tribunal Constitucional (STC 142/2017) sobre la posibilidad de que la normativa autonómica (Andalucía) reguladora de la jornada de trabajo de los empleados públicos (personal docente) pudiera ser inferior a la establecida por normas estatales (normativa coyuntural de estabilidad presupuestaria) sobre las que hay dudas de si constituyen o no normativa básica del régimen jurídico del empleado público.
In the context of the Spanish regulatory framework and the announced legal reduction of the maximum working day to 37,5 hours per week on average on an annual basis, and the debate that this has generated, the legal interpretation of Fernando Valdés Dal Ré in this Judgment of the Constitutional Court STC 142/2017 on the possibility that the regional regulations (Andalusia) regulating the working hours of public employees (teaching staff) could be lower than those established by state regulations (temporary budget stability regulations) about which there are doubts as to whether or not they constitute basic regulations of the legal regime of public employees.
