El adulterio : discurso jurídico y discurso literario en la Baja Edad Media

Abstract

Un análisis de la figura del adulterio en el marco histórico de la baja edad media a través del estudio de dos modalidades de fuentes de conocimiento, las de carácter jurídico y literario. El análisis se centra en la investigación sobre los dos tipos de discursos que emanan de ambas fuentes. Desde la perspectiva júrico-secular se ha estudiado el delito de adulterio, como conducta que pone en peligro el sistema de valores de la sociedad bajo medieval castellano-leonesa, a partir de sus orígenes tanto desde la perspectiva del derecho romano, como del derecho germánico. Así como un estudio de los fueros y de los textos territoriales castellanos. Otro aspecto contemplado es el estudio de la figura del adulterio y su incidencia en el derecho matrimonial canónico a través de las fuentes jurídico-canónicas, especialmente en relación al impedimento para contraer matrimonio y las consecuencias para la disolución del matrimonio. Por ultimo se analiza el fenómeno del adulterio a la luz de los textos que componen el ciclo de la novela arturica y la historia de Lanzarote del lago.
