A violência sexual contra mulheres em situação de conflito armado

Abstract

Durante séculos, e até hoje, as mulheres são umas das vítimas invisíveis dos conflitos armados. Sendo que, em virtude das raízes e conotação machista e patriarcal do contexto de guerra, a Violência Sexual é vista como uma consequência, quase que inevitável da mesma. Neste trabalho iremos analisar a evolução da legislação internacional, no que concerne a este assunto, nomeadamente quanto ao facto da mesma deixar de ser vista como uma mera consequência dos conflitos armados, para passar a ser reconhecida como Crime de Guerra, Crime Contra a Humanidade e Crime de Genocídio. Para tal, iremos interligar esta legislação com a sua aplicação prática, nomeadamente através da análise da Jurisprudência do Tribunal Penal Internacional para a Jugoslávia, Tribunal Penal Internacional para o Ruanda e Tribunal Penal Internacional, a qual constituiu uma importante forma de progresso quanto aos Direitos das Mulheres e ainda no que toca ao combate à impunidade dos agressores e violadores das normas de Direito Internacional, nesta matéria.

For centuries, women have been the ‘invisible victim’ of armed conflict. Rooted in the sexist and patriarchal context of war, Sexual Violence is seen as an almost inevitable consequence of it. Throughout this essay we will analyze the evolution of international law on the subject, namely regarding it ceasing to be a mere consequence of armed conflict, to being established as a War Crime, Crime Against Humanity, and Genocide. We’ll be doing that by intertwining this legislation with its applicability, particularly though the analysis of jurisprudence of the International Criminal Court for Yugoslavia, International Criminal Court for Rwanda and the International Criminal Court, which became a cornerstone regarding progress in Women’s Rights and the combat on the impunity of the aggressors and prevaricators of International Law on this subject.
