Abstract

Esta tese de mestrado avalia o papel da ASD na redução efectiva da prevalência de padrões obscuros nas plataformas em linha na UE, bem como as implicações para a concorrência na economia digital da UE em relação ao aumento da utilização de padrões obscuros. Embora a legislação anterior da UE, como a DPCD e o RGPD, tenha abordado parcialmente certos padrões obscuros, faltava legislação que abordasse diretamente o problema. A ASD visa criar espaços em linha mais seguros para os utilizadores, bem como garantir a proteção dos direitos fundamentais de todos os utilizadores, o que implica a redução ou eliminação dos padrões obscuros. Além disso, a tese tem como objetivo avaliar o impacto da omnipresença dos padrões obscuros na concorrência da UE, em especial na economia digital, e a forma como o ASD contribui para restabelecer o equilíbrio e impedir que as empresas dominem o mercado de forma desleal. Ao incorporar vários estudos de fontes secundárias, as conclusões indicam a necessidade de uma abordagem especializada no combate aos padrões obscuros no futuro, devido à sua rápida evolução, bem como a necessidade de uma abordagem multidisciplinar para enfrentar eficazmente as ameaças colocadas pelos padrões obscuros. Embora o DSA seja considerado eficaz para um grande número de padrões negros, não aborda adequadamente formas mais evoluídas, como os padrões negros hiper-envolventes.

This master’s thesis evaluates the role of the DSA in effectively reducing the prevalence of dark patterns on online platforms in the EU, as well as the implications for competition in the EU’s digital economy in relation to the increased use of dark patterns. Although previous EU legislation, such as the UCPD and GDPR, partially addressed certain dark patterns there was a lack of legislation directly addressing the problem. The DSA aims to create safer online spaces for users as well as ensure the fundamental rights of all users are protected, which entails reducing or eliminating dark patterns. Furthermore the thesis aims to evaluate how the omnipresence of dark patterns has impacted EU competition, particularly the digital economy and how the DSA aids in restoring balance and preventing companies from unfairly dominating the market. By incorporating various studies from secondary sources the conclusions indicate the need for a specialized approach in tackling dark patterns in the future due to their rapid evolution as well as the need for a multidisciplinary approach to effectively address the threats posed by dark patterns. Although the DSA is deemed effective for a large number of dark patterns, it does not adequately address more evolved forms such as hyper-engaging dark patterns.
