O presente artigo tem como objetivo avaliar as potencialidades e limitações do recurso à Prova Digital na ação policial da Guarda Nacional Republicana. Analisaram-se processos-crime, comparando inquéritos com e sem Prova Digital, para determinar a influência na investigação do crime de Violência Doméstica. Adicionalmente, aplicaram-se inquéritos por entrevista e por questionário, com o intuito de incorporar no estudo as experiências de profissionais da área. Recorreu-se a uma estratégia metodológica de estudo de caso, realizado no Núcleo de Investigação e Apoio a Vítimas Específicas do Comando Territorial de Leiria. Os resultados permitem concluir que a Prova Digital é fulcral na investigação do crime de Violência Doméstica, contribuindo para uma maior taxa de acusação. Identificaram-se certas caraterísticas dos casos em que a Prova Digital é utilizada, nomeadamente as idades mais jovens dos envolvidos e o facto de o agressor possuir um perfil controlador/possessivo, muitas vezes cometendo o crime à distância. A importância da formação, atualização dos equipamentos técnicos e da legislação, bem como o aumento dos recursos humanos foram salientados como necessários para melhorar a capacidade de análise da Prova Digital. || The aim of this article is to assess the potential and limitations of the use of Digital Evidence in the police action of the National Republican Guard. Criminal cases were analyzed, comparing inquiries with and without Digital Evidence, to determine its influence on the investigation of the crime of Domestic Violence. In addition, interview and questionnaire surveys were used to incorporate the experiences of professionals in the field into the study. A case study methodological strategy was used, carried out at the Investigation and Support Center for Specific Victims of the Leiria Territorial Command. The results allow us to conclude that Digital Evidence is central to the investigation of the crime of Domestic Violence, contributing to a higher prosecution rate. Certain characteristics of the cases in which Digital Evidence is used were identified, namely the younger ages of those involved and the fact that the aggressor has a controlling/possessive profile, often committing the crime from a distance. The importance of training, updating technical equipment and legislation, as well as increasing human resources were highlighted as necessary to improve the ability to analyze digital evidence.
