Abstract

O abuso sexual de crianças no ciberespaço é um problema bastante atual que vivemos. As novas tecnologias e o desenvolvimento dos meios de comunicação que facilitam a transmissão constante de conteúdos veio fomentar a partilha e divulgação de materiais pedopornográficos. Fazemos uma análise ao Crime de Pornografia de Menores e a todas as suas alterações até o dia de hoje, mencionando a importância de adaptarmos a nossa lei aos tempos recorrentes e escrutinando as diferenças entre a mera posse e a mera visualização ou acesso e as penas associadas, tendo em mente não só os direitos da criança assim como os direitos daqueles que fazem uso normal destas novas tecnologias, podendo um dia, erroneamente aceder a este tipo de conteúdo sem qualquer intenção. Releva também a menção das consequências do período que agora atravessamos, e como uma pandemia em tempos modernos traz consigo não só um aumento exponencial de vários tipos de crimes, nomeadamente os abusos sexuais de menores, mas também pela clara demonstração de falta de conhecimento e consciencialização do correto e seguro uso dos novos meios de comunicação que permitisse garantir a segurança das crianças. Face aos problemas com as investigações e o próprio constante desenvolvimento das tecnologias que abrem portas a novos tipos de crimes, a nossa lei vem impor novas metodologias que põem em funcionamento o conhecimento que adquirimos acerca das novas tecnologias e meios de comunicação, procurando dar resposta ao fenómeno que a lei anteriormente não conseguia responder, pois, tratando-se de um crime que ocorre numa forma não convencional, que ocorre através da utilização de tecnologia e sendo a localização do agente muitas vezes desconhecida ou absolutamente diversa da localização da vítima, não permitiria a aplicação de soluções tradicionais à sua investigação e penalização, considerando neste aspeto os novos métodos de recolha de prova digital e por fim analisando a forma como vários Estados-Membro escolheram aplicar a Diretiva 2011/92/EU no seu direito interno, mostrando a importância de uma uniformização dos direitos das crianças e uma harmonia na cooperação de vários países na prossecução de crimes desta natureza que ocorrem no ciberespaço.

Child sexual abuse in cyberspace is an ongoing problem that we live with. The new technologies and the development of the media that facilitate the constant transmission of content have fostered the sharing and dissemination of child pedopornographic materials. We analyze the Crime of Child Pornography and all its amendments to this day, mentioning the importance of adapting our law to the present times and scrutinizing the differences between mere possession and mere viewing or access and the associated penalties, bearing in mind not only the rights of the child as well as the rights of those who make normal use of these new technologies, but that may also one day mistakenly access this type of content without any intention. It's important to mention the consequences of the period we are now going through, and how a pandemic in modern times brings not only an exponential increase in various types of crimes, namely the sexual abuse of minors but also the clear demonstration of lack of knowledge and awareness of the correct and safe use of new media that would ensure the safety of children. Given the problems with investigations and the constant development of technologies that open doors to new types of crimes, our law imposes new methodologies that put into operation the knowledge we acquire about new technologies and media, seeking to respond to the phenomenon that the law previously could not respond to, in the case of crimes occurring in an unconventional form, which could occur through the use of technology, being the location of the agent often unknown or different from the location of the victim, would not allow the application of traditional solutions to their investigation and penalization, considering the new methods of collecting evidence digitally and finally analyzing how several Member States have chosen to apply the Directive 2011/92/EU in their national law, reinforcing the importance of uniformity of children's rights and harmony in the cooperation of several countries in the pursuit of crimes of this nature that occur in the cyberspace.
