Abstract

Os medicamentos falsificados são “qualquer medicamento com uma falsa apresentação da sua identidade, da sua origem ou, da sua história”. Estes produtos não podem ser considerados equivalentes aos medicamentos originais em termos de qualidade, segurança e eficácia.Com este trabalho pretende-se estudar o problema, as causas, o impacto a nível da saúde pública, bem como o impacto socioeconómico e, a resposta regulamentar tanto a nível nacional, como internacional. Pretende-se também discutir o impacto da nova legislação europeia nesta área e no circuito do medicamento em Portugal. Para o efeito, foi realizada uma revisão bibliográfica sobre o tema, e ainda uma revisão da regulamentação publicada até ao momento, os seus efeitos práticos e limitações, e os esforços conjuntos para otimizar a segurança na compra de medicamentos no comércio regulado e no circuito online, que se tem expandido nos últimos anos. A circulação de medicamentos falsificados é, acima de tudo, um problema de saúde pública, e a dissociação aos problemas com os Direitos de Propriedade Intelectual foi um dos grandes marcos na última década. Apesar da falsificação de medicamentos não ser um conceito recente, ganhou uma nova dimensão devido à globalização, à grande complexidade das cadeias de fabrico/distribuição de medicamentos, e à popularização crescente das compras através da Internet. A implementação do processo de serialização, através da Diretiva e Regulamento Europeus, permite a autenticação do medicamento durante o seu percurso na cadeia de distribuição e garante uma maior segurança aos consumidores. Todavia, a disponibilização de medicamentos através da Internet apresenta novos desafios e requer novas medidas para minimizar o risco de exposição a medicamentos falsificados.

Falsified medicines are “any medicinal product with a false representation of its identity,its source or, its history”. These products cannot be considered equivalent to the original ones in terms of quality, safety, and efficiency.The aim of this work is to study the problem, the causes, the impact on public health as well as the socioeconomic impact and, the regulatory response at both national and international levels. It is also intended to discuss the impact of the new European legislation in this area and in the medicine circuit in Portugal.For this purpose, a bibliographic review on the subject was carried, as well as a review of the published regulations up to now, their practical effects and limitations, and joint efforts to optimize the safety of the purchase of medicines in the regulated trade, but also in the online commerce, which has expanded in recent years.The circulation of falsified medicines is, above all, a public health problem, and the dissociation from problems with the Intellectual Property Rights was one of the major milestones over the last years. Although medicine falsification is not a recent concept, it has gained a new proportion due to globalization, the great complexity in medicines manufacturing/distribution chains, and the growing popularization of online shopping.The implementation of the serialization process, through the European Directive and Regulation, allows the authentication of each unit during its journey through the distribution chain and guarantees a greater security for consumers. Contrary to the higher security in the regulated supply chain, online availability of medicines presents new challenges and requires new measures to minimize the risk of exposure to falsified medicines.
