Abstract

Apoiada nas teorias de origem e de separação dos Poderes de Montesquieu e Benjamin Constant, pretende esta investigação resgatar o caminho jurídico-histórico brasileiro a partir de 1808 — o contexto pós-revolucionário e os cenários pré e pós-independência — culminando na Constituição Política do Império do Brasil de 1824. Tem-se como escopo a compreensão do Poder Político do século XIX e, finalmente, a análise da recepção de um quarto Poder, o Moderador, na primeira Constituição brasileira. O Quarto Poder fora sustentado por uma longeva Constituição, atrelado à Monarquia Constitucional dos Bragança e à influência dos discursos filosóficos e revolucionários daqueles tempos. Nestes moldes, o Poder Moderador perfaz tema central desta pesquisa, posto que se busca compreender a sua razão de existência, seu significado, suas particularidades, e com isso, assimilar o caminho sui generis trilhado pela América portuguesa. Based on Montesquieu's and Benjamin Constant's theories on the origin and separation of Powers, this investigation intends to trace Brazil’s legal-historical path starting in 1808 — the post-revolutionary context and the pre and post-independence scenarios — culminanting in the Political Constitution of the Empire of Brazil of 1824. The purpose is to understand the Political Power of the nineteenth century and, finally, to analyze the reception of a fourth Power, the Moderator, in the first brazilian Constitution, linked to the Constitutional Monarchy of the Bragança’s and the influence of the philosophical and revolutionary discourses of those times. In this sense, the Moderator Power is the central theme of this research, since we seek to understand the reason for its existence, its meaning, its particularities and, by this means, assimilate the sui generis path taken by portuguese America.
