Abstract

Com a intensificação universal da ideia de autodeterminação pessoal, no domínio da saúde não se dispensará exigências correspondentes, sendo que, perante a solicitação do paciente, o médico deixará de a poder aceitar sem maior reflexão ou simplesmente a ignorar invocando a liberdade e independência profissional. Configurando os atos médicos atividade de risco, o problema nuclear traduz-se em saber quem os deve assumir e em que medida, daí surgir a figura do consentimento informado - instrumento para transferir os riscos imanentes a certa intervenção que de outra forma se manterão na esfera da responsabilidade do médico. O presente estudo versa sobre a responsabilidade médica, no horizonte civil, devido à falta de consentimento informado, em relação às suas causas de invalidade extrínsecas e intrínsecas, nomeadamente o efeito da utilização de formulários de consentimento e a existência de capacidade para consentir, e questões respeitantes à natureza jurídica do consentimento, ao ónus da prova, aos requisitos da responsabilidade civil, especialmente ao nexo de causalidade, às situações excecionais à responsabilidade e a eventual responsabilização médica face ao dissentimento do paciente. Pretendemos inclusivamente averiguar o regime jurídico vigente relacionado com esses aspetos, atendendo aos seus valores, finalidades e funções essenciais, em articulação com os direitos fundamentais, maxime, os direitos da personalidade, no sentido de concluir com determinadas correções, melhorias e reforços oportunos para uma implementação integral do instituto em análise.

With the universal intensification of the idea of personal self-determination, neither in the field of health would be exempted from corresponding requirements, and, at the solicitation of the patient, the physician would no longer be able to accept it without further reflection or simply ignore it by invoking professional freedom and independence. Since medical acts contain risks, the nuclear problem is to know who assumes them and to what extent, hence the figure of informed consent - an instrument to transfer the risks immanent to a certain intervention that would otherwise remain within the sphere of the physician's responsibility. The present study deals with medical liability in the civil horizon due to lack of informed consent, in relation to its extrinsic and intrinsic causes of invalidity, namely the effect of the utilization of consent forms and the existence of the ability to consent, and issues concerning the legal nature of consent, the burden of proof, the requirements of civil liability, especially the causation, the exceptional situations of liability and possible medical liability in the face of the patient's dissent. We propose to investigate inclusively the current legal regime related to these aspects, taking into account their essential values, purposes and functions, in conjunction with the fundamental rights, maxime, the personality rights, in order to conclude with certain corrections, improvements and reinforcements that are opportune for an integral implementation of the institute under review.
