Abstract

O presente trabalho compreende um estudo do direito do consumidor, especificamente, uma análise dos princípios da proteção, da vulnerabilidade e da hipossuficiência a luz do Código de Defesa do Consumidor. Referidos princípios são dirigidos a promoção de uma proteção efetiva dos vulneráveis, os consumidores, na busca de relações de consumo mais equitativas e equilibradas. Para tanto, a metodologia utilizada foi referências bibliográficas na doutrina, na legislação e na jurisprudência brasileira e portuguesa. A temática da tutela do consumidor, como a conhecemos hoje, e o consequente surgimento do direito do consumidor como categoria jurídica autônoma, são relativamente recentes nas sociedades. A doutrina dominante refere serem decorrentes diretamente dos movimentos organizados dos consumidores, o consumerismo lato sensu , que representou e representa um embate entre o poder econômico, técnico e político dos produtores e a necessidade de proteção dos consumidores. A sua finalidade precípua é restaurar o equilíbrio de forças nas relações de consumo , marcadamente desiguais. O direito de proteção ao consumidor é um direito fundamental, um direito de terceira geração que transcende o indivíduo, isto é, um direito que pertence à categoria dos direitos transindividuais, os chamados direitos de solidariedade e fraternidade. Esses direitos estão relacionados à essência do ser humano, como gênero humano pertencente a uma coletividade, a humanidade. Dessa forma, a efetividade da proteção dos consumidores, a parte mais frágil da relação de consumo, é de fundamental importância para o próprio sistema econômico e político, sem, contudo, tal salvaguarda obstaculizar o papel dos empreendedores, e o desenvolvimento econômico.

This study includes a study of consumer law, specifically an analysis of the principles of protection, vulnerability and hyposufficiency in the light of the Consumer Protection Code. These principles are advocated to promote the effective protection of the vulnerable, consumers, in the search for more equitable and balanced consumer relations. For that, the methodology used was bibliographical references in doctrine, in the legislation and in Brazilian and Portuguese jurisprudence. The issue of consumer protection, as we know it today, and the consequent emergence of consumer law as an autonomous legal category, are relatively recent in societies.The dominant doctrine refers to being directly derived from the organized movements of the consumers, the consumerism lato sensu, that represented and represents a clash between the economic, technical and political power of the producers and the need of protection of the consumers. Its primary purpose is to restore the balance of forces in consumer relations, which are markedly unequal.The right of consumer protection is a fundamental right, a third generation right that transcends the individual, that is, a right that belongs to the category of transindividual rights, the so-called rights of solidarity and fraternity. These rights are related to the essence of the human being, as a human being belonging to a collectivity, humanity. Thus, the effectiveness of consumer protection, the most fragile part of the consumption relationship, is of fundamental importance to the own economic and political system, without, however, such a safeguard hampering the role of entrepreneurs, and economic development.
