Diante da pessimista conjuntura global resultante das graves crises humanitárias que eclodiram ao final da Guerra Fria, em diferentes regiões do globo, e da forma pela qual estas foram enfrentadas, notadamente pela ONU, nasce no cenário internacional, no ano de 2001, o conceito da responsabilidade de proteger (R2P). Fundamentada numa reformulação do significado de soberania, a concepção da R2P, proposta pela ICISS, iluminou a responsabilidade dos Estados em proteger as suas próprias populações de catástrofes humanitárias e, também, a responsabilidade da comunidade internacional em ajudar os Estados a dar cumprimento às suas responsabilidades em termos de proteção caso um Estado se revele incapaz ou indisposto em fazê-lo, tudo a partir de uma escalada de ações preventivas, reacionárias e reconstrutivas. Em virtude dos seus contornos teóricos, políticos e práticos, a R2P tornou-se um tema de substanciais análises em Direito Internacional, especialmente no que toca à sua operatividade. Nesse contexto, a presente dissertação tem por objetivo debruçar-se sobre a responsabilidade de proteger e suas respectivas particularidades para, após, ocupar-se em analisar as implicações jurídicas extraíveis de sua formulação que, ao nosso olhar, são capazes de transportá-la da zona do discurso político para aquela da efetiva prática, em específico: a) a legitimação das intervenções humanitárias unilaterais em caso de bloqueio do CSNU; e b) a obrigação de cooperar dos Estados não-parte do Estatuto de Roma do Tribunal Penal Internacional. Sob essa perspectiva, portanto, busca-se concluir que o reconhecimento dessas implicações jurídicas na prática da R2P viabilizará a materialização de seu fim maior: a adequada proteção das populações civis expostas à situações de calamidade humanitária.

Faced with the pessimistic global situation resulting from the humanitarian crises that emerged at the end of the Cold War, in different regions of the globe, and the way in which they were confronted, notably by the UN, was born on the international scene in 2001 the concept of the responsibility to protect (R2P). Grounded on a reformulation of the meaning of sovereignty, the conception of R2P proposed by ICISS illuminated States' responsibility to protect their own populations from humanitarian disasters and also the responsibility of the international community to help States fulfill their responsibilities in terms of protection if a state proves incapable or unwilling to do so, all from an escalation of preventive, reactionary and reconstructive actions. Due to its theoretical, political and practical aspects, R2P has become a subject of substantial analysis in International Law, especially as regards its operability. Whitin this context, this dissertation aims to focus on the responsibility to protect and its respective particularities to, after, focus on highlighting the extractable legal implications of its formulation that, in our eyes, are capable of transporting R2P from the political discourse to that of actual practice, specifically: a) the legitimation of unilateral humanitarian interventions in the event of blocking the UNSC; and b) the obligation to cooperate with States not party to the Rome Statute of the International Criminal Court. From this perspective, therefore, we seek to conclude that the recognition of these legal implications in the practice of R2P will enable the materialization of its greater purpose: the adequate protection of the civilian populations exposed to situations of humanitarian calamity.
