Abstract

A presente dissertação surgiu na sequência de um estágio realizado na Comissão de Coordenação de Desenvolvimento Regional do Centro em pareceria com o Departamento de Ciências da Terra (DCT) da Faculdade de Ciências e Tecnologia da Universidade de Coimbra (FCTUC).Devido à natureza das explorações das massas minerais, estas são passíveis de criar impactes negativos em alguns fatores ambientais. Como solução, foi introduzido o conceito de Avaliação de Impacte Ambiental (AIA). A AIA encontra-se definida no Decreto-Lei nº 152-B/2017, de 11 de dezembro como um “instrumento de caráter preventivo da política do ambiente”, aplicado em explorações com grande suscetibilidade de produzirem impactes significativos no ambiente ou que se encontram nos limiares fixados do mesmo decreto-lei. Atua como uma ferramenta de sustentabilidade, tendo como objetivo identificar, avaliar e minimizar os impactes verificados.A AIA é um procedimento complexo, do ponto de vista administrativo e do ponto de vista da concretização prática do mesmo. Encontra-se dividido em seis fases, onde intervêm diferentes entidades que desempenham um papel fundamental para a sua realização adequada.Foram objetivos desta dissertação a verificação da incidência do regime de AIA, relativo ao número de processos de exploração de massas minerais, existentes na CCDRC e a análise dos resultados obtidos de modo a verificar o cumprimento, na prática, e a eficácia do procedimento de AIA na proteção e preservação do ambienteNesta dissertação foram apenas abordados três elementos referentes a três destas fases, sendo eles o Estudo de Impacte Ambiental (EIA), a Declaração de Impacte Ambiental (DIA) e a Pós-Avaliação. Assim, foram analisados, em função das massas minerais e dos fatores ambientais, os impactes, as medidas de minimização e os planos de monitorização propostos pelo EIA, as medidas de minimização e os planos de monitorização estipuladas pela DIA e relatórios de monitorização da Pós-Avaliação.Verificou-se que na teoria o procedimento de AIA constitui uma ferramenta de promoção do desenvolvimento sustentável na exploração de massas minerais, no entanto, na sua prática tal apenas se verifica se existir uma boa realização dos elementos e cumprimentos destes.

This dissertation arises following an internship at Comissão de Coordenação de Desenvolvimento Regional do Centro (CCDRC) in partnership with the Department of Earth Sciences of the Faculty of Science and Technology of the University of Coimbra. Due to the nature of the mineral masses, they are likely to create negative impacts on some environmental factors. As a solution, the concept of Environmental Impact Assessment (EIA) was introduced.The EIA is defined in Decree-Law no. 152-B / 2017, of December 11, as a "preventive instrument of environmental policy", applied in projects with great susceptibility to produce significant impacts on the environment or that are fixed thresholds of the same decree-law. It acts as a sustainability tool, aiming to identify, evaluate and minimize the verified impacts.The EIA is a complex procedure, from an administrative point of view and from the point of view of its practical implementation. It is divided into six phases, where different entities intervene that play a fundamental role for its adequate realization.The objectives of this dissertation were the verification of the incidence of the EIA regime, regarding the number of mining operations in the CCDRC, and the analysis of the results obtained in order to verify the practical fulfillment and effectiveness of the EIA procedure protection and preservation of the environmentIn this dissertation, only three elements referring to three of these phases were discussed: the Environmental Impact Study (EIA), the Environmental Impact Statement (EIS) and the Post-Evaluation. Thus, the impacts, minimization measures and monitoring plans proposed by the EIA, the minimization measures and the monitoring plans stipulated by the EIA and the post-harvest monitoring reports were analyzed based on mineral masses and environmental factors, Evaluation.It has been found that in theory the EIA procedure is a tool for promoting sustainable development in the exploitation of mineral masses; however, in its practice this is only verified if there is a good realization of the elements and compliments thereof.
