The purpose of this dissertation is to reflect on the problematic underlying the system of default in civil procedural law. To this end, I turn to the principles of civil procedural law, namely, the most important, the principle of material truth, foreign legal systems, and compare the present system of civil procedural law with the revelation regime enshrined in the Peace Courts.It is essential to analyze the whole process of the Peace Courts and also the entire system of non-judgment in the scope of the Peace Courts to understand the meaning and concept of the absence, both in the Judicial Courts and in the Peace Courts. In Peace Courts is a more demanding consecration for the verification of the situation of default, all derived from the structure and nature that the Peace Courts present. For all the explanations throughout the dissertation, it seems necessary to change the system of default because it does not guarantee or guarantee the main purposes of Portuguese civil procedural law.The aim is to raise all the issues underlying the problem of non-disclosure and to present a "solution" which allows for exposing the advantages and disadvantages, and the latter do not overlap the advantages. It is necessary and essential to always respect the principles of civil procedural law and, above all, its purposes - discovery of the material truth and fair composition of the dispute. Defenitely, default need another solution, comparing, also, with the foreign orders, like Brasil, spanish, etc.

A presente dissertação tem como finalidade a reflexão acerca da problemática subjacente ao sistema da revelia consagrado no direito processual civil. Para tal, recorro à análise de todo o regime da revelia consagrado no direito processual civil, aos princípios do direito processual civil, nomeadamente, o mais importante, o princípio da verdade material, os ordenamentos estrangeiros e comparo o sistema atual de direito processual civil com o regime de revelia consagrado nos Julgados de Paz. É essencial analisar toda a tramitação dos Julgados de Paz e, também, todo o sistema da revelia no âmbito dos Julgados de Paz para que se entenda o significado e conceito da revelia, quer nos Tribunais Judicias, quer nos Julgados de Paz. Nos Julgados de Paz vigora uma consagração mais exigente para a verificação da situação de revelia, tudo derivado da estrutura e natureza que os Julgados de Paz apresentam. Por tudo o explanado ao longo da dissertação, afigura-se necessário uma alteração ao sistema da revelia porquanto não assegura nem garante as principais finalidades do direito processual civil português. O objectivo é levantar todas as questões que estão subjacentes ao problema da revelia e apresentar uma "solução" que permita expor as vantagens e desvantagens e estas últimas não se sobreporem às vantagens. É necessário e essencial respeitar sempre os princípios do direito processual civil e, principalmente, as suas finalidades - descoberta da verdade material e justa composição do litígio.
