Abstract

O presente trabalho se propõe a analisar a repristinação no âmbito do controle judicial de constitucionalidade dos atos normativos, tanto em sua generalidade, enquanto fenômeno abstrato decorrente de outras premissas ou postulados jurídicos, como em suas específicas configurações na esfera do direito positivo português e brasileiro, através inclusive, nesse ponto particular, de análise comparativa. Ele divide-se em três capítulos. O primeiro traz as linhas gerais a respeito da repristinação, enquanto gênero, e da repristinação judicial, e delimita o tema quanto às espécies normativas e quanto às modalidades de inconstitucionalidade e de seu controle, dentre outros. O segundo aborda especificamente o efeito repristinatório na esfera do controle judicial abstrato sucessivo de constitucionalidade, seu tratamento legislativo e jurisprudencial e seu enquadramento no espectro geral dos efeitos das declarações de inconstitucionalidade em abstrato. This paper intends to analyze the reinstatement of laws in the scope of judicial review both in its generality, as an abstract phenomenon derived from other premises or postulates, and in its specific configurations in the sphere of portuguese and brazilian positive law, including through a comparative analysis in this particular point. It is divided into three chapters. The first one draws the general lines regarding reinstatement, as a genre, and about judicial reinstatement, and delimits the theme regarding normative species and the modalities of unconstitutionality and its control, among others. The second deals specifically with the judicial reinstatement in the sphere of successive abstract judicial review, its legislative and jurisprudential treatment, and its framing in the general spectrum of the effects of the declarations of unconstitutionality.
