Prostitution is coming to the fore and one has to face the European debate.This paper seeks to analyze the historical and social impact of sexuality, prostitution and sexual freedom over the time. Whenever possible we point out evidences from ancillary social sciences. This study concludes for constitutional illegitimacy of prostitution. We broach pimping and the purchase for sexual services. O tema da prostituição tem vindo a lume e impõe-se-nos no plano europeu do debate.Este estudo procura analisar a evolução histórica e social da proeminência da sexualidade, da prostituição e da liberdade sexual. Lançamos mão sempre que possível das ciências auxiliares do Direito. Detetamos na apreensão social daquelas realidades a ilegitimidade constitucional do fenómeno prostitucional. Abordamos dois casos de política legislativa: o lenocínio e a compra de serviços sexuais.
