O presente estudo tem como escopo versar sobre o dever de perseguir e punir crimes internacionais no âmbito da justiça de transição e abordar a problemática que se perfaz acerca da natureza e do fundamento de referido dever. Para cumprir tal propósito, inicialmente, demonstra-se a evolução do conceito de justiça de transição e os dilemas que permeiam seus objetivos, com o fito de elucidar a possível existência trade-offs intransponíveis entre esses ou se, de forma diversa, tais finalidades são indissociavelmente interligadas. Em seguida, realiza-se uma revisão doutrinária e jurisprudencial acerca da natureza e dos fundamentos de referido dever, por meio da análise das obrigações depreendidas de tratados e convenções internacionais, dos requisitos para a cristalização dos costumes internacionais, do princípio aut dedere aut judicare e do princípio da jurisdição universal, bem como das decisões proferidas pela Corte Interamericana de Direitos Humanos e pelas disposições contidas no Estatuto de Roma do Tribunal Penal Internacional, a fim de esclarecer se esse dever constitui um imperativo inderrogável de direito consuetudinário. Por fim, a última parte deste estudo se lança ao exame dos mecanismos complementares à persecução - nomeadamente, comissões da verdade e reconciliação, medidas de reparação, mecanismos de justiça tradicional e leis de anistia -, visando elucidar a necessidade de realizar-se uma abordagem holística e compreensiva à justiça de transição.…………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………………….......................................................................................................................................................

The purpose of this study is to discuss the duty to prosecute and punish international crimes in the field of transitional justice and to address the issues surrounding the nature and basis of this obligation. In order to achieve this goal, this study initially demonstrates the evolution of the concept of transitional justice and the controversy that permeates its objectives, aiming to elucidate whether exists insuperable trade-offs between them, or whether these purposes are mutually dependent. Subsequently, this research reviews the literature and jurisprudence on the duty to prosecute and punish, through an analysis of the rules provided by international treaties and conventions, the requirements of the process of customary law, the aut dedere aut judicare principle and the universal jurisdiction principle, as well as of the decisions handed down by the Inter-American Court of Human Rights and the legal provisions contained in the Rome Statute of the International Criminal Court, in order to clarify whether this obligation constitutes a peremptory norm of customary law.
