A legitimidade do sindicato no processo

Abstract

Tema pouco debatido e explorado pela doutrina, tanto pela doutrina juslaboralista, como pela doutrina processualista, é o tema de saber até que ponto os sindicatos têm legitimidade ativa num determinado processo.Apesar de legislado, entre nós, há já largos anos, não é por isso que não se deixa de levantar um intenso nevoeiro sobre o tema da legitimidade dos sindicatos no processo, um nevoeiro cerrado que impede uma visão clara e límpida de todos os meandros que envolvem esta problemática.Todavia, esta diminuta exploração e desenvolvimento do tema que nos apraz trazer ao cimo, não se prende apenas com o desinteresse daquela parte da doutrina já evidenciada. Com efeito, neste tema da legitimidade processual das associações sindicais estão envolvidas dimensões jurídicas que relevam de outras áreas do direito. Surge, como cabeça de cartaz, a dimensão constitucional, da qual muito falaremos, na medida em que importa saber quais os interesses que os sindicatos estão autorizados a defender e a promover segundo Constituição. Urgem também esclarecimento maior algumas questões de ordem geral como a da personalidade das pessoas coletivas, o problema da representação e da representatividade sindical, e o da relação entre autonomia coletiva e individual dos trabalhadores.E, no que mais nos toca, o que mais nos motiva a escrever estas linhas é a questão de saber se, antes de mais, aos sindicatos cabe apenas a defesa de interesses coletivos ou se estes podem também defender interesses individuais e se, num segundo plano, podem defender interesses individuais mesmo que isso signifique entrar em oposição com interesses individuais de outros associados. Para a responder a tal questão, cabe elaborar uma clara distinção entre os vários tipos de interesses que cabe aos sindicatos defender e como essa defesa está regulamentada no atual regime legal.

A subject that is not much debated and explored by the doctrine, both by the doctrine of justification and by the proceduralist doctrine, is the subject of knowing to what extent the unions have active legitimacy in a given process.Although it has been legislated in Portugal for many years, it is not a license to raise an intense fog on the issue of the legitimacy of the unions in the process, a closed fog that prevents a clear and clear view of all the intricacies That involve this problem.However, this small exploration and development of the theme that we are glad to bring to the top is not only due to the disinterest of that part of the doctrine already evidenced.Indeed, in the issue of procedural legitimacy of trade union associations are involved legal dimensions that fall outside other areas of law. As the head of the bill, a constitutional dimension emerges, much of which we will speak about, insofar as it is important to know which interests are unions are allowed a defender and a promotion according to the Constitution.There is also a need for greater clarification on some general issues such as the personality of legal persons, the problem of representation and union representation, and the relationship between workers' collective and individual autonomy.And what matters most to us, what motivates us most to write these lines is the question of whether, first and foremost, unions are only a defense of collective interests or whether they can also defend individual interests and, in a second Plan can defend individual interests even if it means opposing the interests of other members. For a respondent, enter a clear distinction between the various types of interests that defending unions hold and how this defense is regulated under the current legal regime.
