Abstract

Este presente trabalho teve por objetivo discutir a necessidade de regulamentação das diretivas antecipadas de vontade no ordenamento jurídico brasileiro. Esclarecemos em princípio as diferenças entre eutanásia, distanásia, ortotanásia e cuidados paliativos, por observarmos que as decisões médicas, familiares e até jurídicas, podem gerar conflitos em virtude do desconhecimento sobre os institutos. Buscamos, posteriormente, demonstrar a necessidade de salvaguardar a autodeterminação do paciente no fim de vida, tendo como fundamentação a discussão sobre a autonomia dos pacientes nas decisões sobre o fim de vida, inclusive a recusa aos tratamentos fúteis ou extraordinários, possibilitando uma morte digna, sem que isto se aproxime da liberação para a prática da eutanásia. Analisamos as Diretivas Antecipadas em Portugal, através da Lei 25/2012, e no Brasil, considerando as Resoluções do Conselho Federal de Medicina (Resolução CFM nº 1.805/2006 , de 09.11.2006). Abordamos ainda a responsabilidade médica diante das Diretivas Antecipadas, dentro da relação médico-paciente. O tema adquire relevância por se tratar ao direito à vida, à morte digna, e em virtude da falta de regulamentação do testamento vital no Brasil, ainda que pela interpretação normativa (constitucional e infraconstitucional) nos leve ao entendimento de que ele seja válido.Palavras-Chave: diretiva antecipada de vontade; testamento vital; autonomia; eutanásia; cuidados paliativos.Palavras-Chave: diretiva antecipada de vontade; testamento vital; autonomia; eutanásia; cuidados paliativos

This paper aimed to discuss the need for regulation of the early directives of will in the Brazilian legal system. We clarify in principle the differences between euthanasia, dysthanasia, orthothanasia and palliative care, because we observe that medical, family and even legal decisions can generate conflicts due to the lack of knowledge about institutes. We later sought to demonstrate the need to safeguard the patient's self-determination at the end of life, based on the discussion about the autonomy of patients in decisions about the end of life, including refusing futile or extraordinary treatments, enabling a dignified death, Without this approaching liberation for the practice of euthanasia. We analyzed the Anticipated Directives in Portugal, through Law 25/2012, and in Brazil, considering the Resolutions of the Federal Council of Medicine (CFM Resolution 1,805 / 2006, dated 11.11.2006). We also address medical liability to the Advance Directives, within the doctor-patient relationship. The issue becomes relevant because it deals with the right to life, dignified death, and because of the lack of regulation of the living will in Brazil, even though the normative interpretation (constitutional and infraconstitutional) leads us to the understanding that it is valid.Keywords: anticipated directives; living will; eutanásia; palliative care.Keywords: anticipated directives; living will; eutanásia; palliative care.Keywords: anticipated directives; living will; eutanásia; palliative care.
