Abstract

O presente estudo realiza uma análise do crime de estupro sob uma perspectiva de gênero, através de uma ótica multidisciplinar e interdisciplinar, compreendendo-o como produto das relações sociais desiguais entre homens e mulheres e, ao mesmo tempo, como forma de manutenção dessa realidade hierarquizada. Essa atmosfera resulta na chamada cultura do estupro, ou seja, um contexto no qual comportamentos machistas, sexistas e misóginos, que culminam muitas vezes em agressões sexuais e outras formas de violência contra as mulheres é naturalizado e legitimado. Nesse sentido, se demonstra que, dado tratar-se de uma cultura, esta foi construída pelo Homem, e, assim, por ele pode e deve ser desconstruída. Nessa premissa, se analisam os que julgamos ser os três principais pilares da construção da cultura do estupro, quais sejam, religião, Direito e arte, na tentativa de mostrar que estes podem se tornar os três principais pilares da desconstrução desta, numa ação concomitante e/ou reflexa, tendo em vista que para que ocorra uma mudança de paradigma deve ocorrer uma revolução transversional. Ou seja, uma mobilização generalizada em que todas as esferas da sociedade devem participar dessa transformação. Para isso, será feita uma análise conjuntural – histórica, social, cultural, artística, religiosa e normativa – em que a violência sexual contra a mulher se manifesta e se legitima, a fim de demonstrar que as noções preconcebidas e os estereótipos relacionados a esse crime possuem explicações frágeis e insustentáveis que podem ser superadas, tendo em vista que o poder de acabar com a cultura do estupro está em nossas mãos. Só precisamos estendê-las.

The present study analyzes the crime of rape from a gender perspective through amultidisciplinary and interdisciplinary perspective, understanding it as the product ofunequal social relations between men and women and, at the same time, as a way ofmaintaining this hierarchical reality. This atmosphere results in the so-called rape culture,in a context in which sexist and misogynist behavior, often culminating in sexual assaultand other forms of violence against women, is naturalized and legitimized. In this sense, itis shown that, since it is a culture, it has been constructed by Man, and thus can and shouldbe deconstructed by Man. In this premise, we analyze what we consider to be the threemain pillars of the construction of rape culture, namely, religion, law and art, in an attemptto show that these can become the three main pillars of the deconstruction of it, in aconcomitant action or reflex, considering that for a paradigm shift to take place a crosssectionalrevolution must occur. That is, a generalized mobilization in which all spheres ofsociety must participate in this transformation. To this end, a conjunctural analysis -historical, social, cultural, artistic, religious and normative - will be made in which sexualviolence against women is manifested and legitimized in order to demonstrate thatpreconceived notions and stereotypes related to this crime have fragile and unsustainableexplanations that can be overcome, given that the power to end the culture of rape is in ourhands. We just need to extend them.
