Abstract

Constitui objeto de estudo da presente dissertação versar sobre a legitimidade da intervenção penal na conduta, prevista como crime, respeitante à detenção de material pornográfico com representação realista de menor se e quando diga respeito a dois modelos de pedopornografia, a virtual total e a aparente. O presente trabalho tem por objeto o estudo destes fenómenos e a sua relevância jurídico-penal no que à teoria do bem jurídico concerne. É para nós manifesto que as conceções moralistas e ideológicas relevam no seio políticocriminal - todavia, somente quando se consubstanciam numa lesão à subsistência de uma comunidade. Desta feita, proceder-se-á à análise destes modelos, bem como ao estudo do bem jurídico protegido nos crimes sexuais em geral, à luz das conceções moralistas que ainda inspiram o legislador, considerando o princípio da necessidade penal. A exposição argumentativa vai no sentido de desconsiderar a legitimidade do ius puniendi no que àqueles modelos respeita, por se tratarem de condutas que, apesar de socialmente intoleráveis, não apresentam dignidade penal. ABSTRACT This dissertation discusses the legitimacy of the intervention of Criminal Law on the conduct, foreseen as a crime, concerning the possession of pornography containing realistic representation of minors if and when it concerns to certain models of child pornography, the entirely virtual and the apparent. We discuss the legal and criminal relevance of these phenomena in what regards the theory of legal goods. Moralistic and ideological conceptions matter for the political and criminal domains, but only when an injury to the livelihood of a community is at stake. Therefore, by considering the principle of necessity, we analyse these models, as well as the legal good as protected in the legal framework related to sexual crimes in general, with a focus on the moralistic ideals that still inspire the legislator. We argue towards the illegitimacy of Criminal Law for the intervention on those models, considering that those conducts, even intolerable, do not present criminal dignity
