Quando os direitos das minorias sexuais também são direitos humanos: regulação versus emancipação

Abstract

O regime internacional de direitos humanos tem vindo a expandir-se por forma a incluir temáticas cada vez mais específicas, entre as quais se podem destacar os direitos das crianças, das minorias étnicas, das mulheres ou das minorias sexuais. Do ponto de vista dos movimentos específicos que estas normas visam proteger, a utilização deste tipo de argumento pode equivaler, pelo lado mais emancipatório, a um maior poder de pressão e robustez na base social de apoio ou, numa vertente mais regulatória, a uma crescente normalização dos padrões comportamentais e modelos relacionais. Com base na minha investigação sobre o movimento lésbico, gay, bissexual e transgénero (LGBT) português, este trabalho visa, por um lado, enquadrar as práticas discursivas e de acção deste movimento na temática mais ampla do regime internacional de direitos humanos, por outro, revelar as articulações entre movimentos sociais que esta abordagem permite, e, finalmente, problematizar os impactos quer regulatórios quer emancipatórios que a retórica dos direitos humanos implica para o movimento LGBT.
