Abstract

A «publicidade financeira» efectuada em Portugal, independentemente do Estado-membro de origem da "empresa financeira" anunciante, encontra-se sujeita a um regime dualista, quer no plano substantivo, quer no plano adjectivo, em função da actividade financeira publicitada. No plano substantivo, consoante se trate de publicidade de serviços financeiros, em geral, ou, de publicidade de serviços de intermediação de valores mobiliários (que apenas certas 'empresas financeiras' podem prestar), em particular, será aplicável, respectivamente, o regime geral previsto no Código da Publicidade (CPub) ou o regime especial previsto no CMVM. No plano adjectivo, é, indistintamente, afastado o regime previsto no CPub, tendo competência para a fiscalização, instrução de processos de ilícito de mera ordenação social, aplicação das sanções e medidas de intervenção, respectivamente, o Banco de Portugal ou a Comissão do Mercado de Valores Mobiliários.
