Abstract

What is the Purpose of Punishment in Today's World? The purpose of punishment is perhaps one of the most recurrent themes in academic research aiming to understand the effects of this legal intervention, which is sometimes seen as retribution or a limitation on the state's punitive power, and at other times as a formal mechanism of control against acts that threaten legal interests shared by all. However, it is necessary to acknowledge that legal doctrine has increasingly questioned this role, particularly due to the lack of data confirming the preventive nature of sanctions imposed by the state. Considering this conflict, one might ask whether this preventive approach could either provoke hyper-selectivity or conceal hidden figures stemming from the supposed ineffectiveness of current measures in reducing crime.While such doubts may foster a widespread sense—one that penal science cannot ignore—that the causes of crime and the interventions designed to address it might not be adequately identified, understood, or implemented, this uncertainty often leads to the misuse of punitive power, resulting in collateral consequences that are even more harmful to incarcerated individuals and those reentering society. These consequences include segregation, exclusion, alienation from the labor market, and social desocialization.This research does not aim to exhaustively analyze the functions of punishment but instead seeks, through the hypothetical-deductive method, to investigate how the penal system, culpability, and freedom can be integrated into a single study to develop a penal execution model that is more inclusive, democratic, and respectful of the dignity of the incarcerated individual as a subject of rights. Although dogmatic in its nature and based on a bibliographic review of the subject—especially regarding punishment—this work seeks to develop its foundation, freedom, as a criterion of validity, balancing philosophical perspectives and criminological studies to affirm its necessity in the current Democratic Rule of Law and considering the principles that limit the state's punitive power.Thus, the discussion begins with the following questions: If punishment serves the purpose of protecting legal interests, can this function be confirmed? If so, how? Can punishment deter crime as a factor that influences free will? How can it be made effective?The objective of this study, therefore, is to realign the function of punishment with the protection of legal interests and its role in the exercise of free will. This will be achieved through studies on the concept of culpability itself, which connects the assessment of criminal responsibility with the ability to act otherwise. In essence, this work seeks to explore punishment as a space to expand the incarcerated individual's access to citizenship rights, fostering awareness of fundamental rights to enable them to live in freedom. Through this process, the individual's personality can voluntarily align with constitutional values, enabling them to act freely and in harmony with criminal norms in the broader context of fundamental rights' efficacy.How would this be accomplished? The proposal is to explore how punitive power, from the perspective of punishment enforcement, must (in a deontological sense) become a genuine obligation of the state to provide minimum conditions for the personal development of the incarcerated individual upon their reintegration into society. Thus, the function of punishment aligns with the protection of legal interests to mutually promote peaceful coexistence between former offenders and society. Consequently, the study seeks to consolidate three foundations upon which the hypothesis will be constructed: the preventive purpose of punishment during its execution phase, the individual's reaction—both individually and collectively—and a philosophy capable of fostering an awareness of acting according to the law to protect the legal interests of other members of society.The chosen paradigm of freedom is compatibilist philosophy, which affirms that punishment can assist the individual through its resocializing function, enabling them to shape their own personality and exercise free will (the foundation of punishment) in a way that is more compatible with constitutional values. Relying on two aspects—technical and moral virtue—the state provides elements to develop the incarcerated individual's citizenship throughout their sentence. These aspects should be developed through access to social rights with the voluntary participation of the incarcerated individual, although imposed upon the state, so that both inside and outside the penitentiary system, the individual can balance their being and acting in accordance with constitutional principles, respecting the effectiveness of fundamental rights in their social relationships. Could these elements justify the necessity of punishment? Yes.

Para que serve a pena no mundo atual? A função da pena talvez seja um dos temas mais recorrentes em pesquisas acadêmicas que visam compreender os efeitos dessa intervenção jurídica, que ora é tida como retribuição ou limite ao poder punitivo estatal, ora como instrumento de controle formal contra atos que visam atingir bens jurídicos compartilhados por todos. Contudo, é necessário reconhecer que a doutrina vem questionando esse papel diante da ausência de dados que confirmem especialmente o caráter preventivo de uma sanção imposta pelo Estado. Diante desse conflito, questiona-se se essa abordagem preventiva poderia provocar ora uma hiperseletividade, ora cifras ocultas diante da suposta ausência de eficácia sobre os meios para reduzir o fenômeno do crime. Embora essa dúvida possa estimular uma sensação generalizada (e que, por tal razão, a ciência penal não pode ignorar) de que as causas e as intervenções talvez não estejam sendo identificadas, compreendidas ou bem executadas, sabe-se que tudo isso favorece o uso indevido do poder punitivo para provocar efeitos colaterais ainda mais prejudiciais aos presos e egressos, incluindo os fenômenos de: segregação, exclusão, afastamento do mercado de trabalho e dessocialização. Esta pesquisa não pretende esgotar a análise sobre as funções da pena, mas se propõe a investigar, pelo método hipotético-dedutivo, como o sistema penal, a culpa e a liberdade podem ser reunidos num mesmo estudo para desenvolver uma execução penal mais inclusiva, democrática e que respeita a dignidade do preso como sujeito de direitos. Embora dogmático, propondo-se uma revisão bibliográfica sobre o tema, especialmente no que se refere à pena, este trabalho busca desenvolver o seu fundamento, a liberdade, como critério de validade, sopesando visões filosóficas e estudos da criminologia para confirmar a sua necessidade frente ao Estado Democrático de Direito atual e aos princípios que limitam o poder punitivo estatal. Portanto, pode-se iniciar com a seguinte questão: se a pena tem a função de tutelar bens jurídicos, essa função pode ser confirmada? De que forma? A pena pode dissuadir a prática do crime como um fator que altera o livre-arbítrio? Como torná-la efetiva no sentido de garantir a reinserção social do egresso sem torná-la moralizante e autoritária?O objetivo deste trabalho é, portanto, realinhar a função da pena, a proteção de bens jurídicos e o seu papel para o livre-arbítrio. Isso se faz a partir de estudos sobre o próprio conteúdo da culpa quando se relaciona a apuração da responsabilidade penal com o poder de agir de outro modo. Em verdade, pretende-se explorar a pena como espaço para aumentar o acesso a direitos de cidadania do preso, fomentando a conscientização dos direitos fundamentais para lhe permitir viver em liberdade, em que se molda voluntariamente a personalidade do agente aos valores constitucionais para lhe possibilitar agir livremente e de modo que sua conduta esteja em harmonia com a norma penal no plano da eficácia dos direitos fundamentais. E como isso seria realizado? Propõe-se explorar como o poder punitivo, sob a perspetiva do cumprimento da pena, deve (em sentido deontológico) tornar-se efetivamente uma obrigação dirigida ao Estado para possibilitar condições mínimas para o desenvolvimento pessoal do reeducando quando reingressar à sociedade. Assim, une-se a função da pena com a proteção de bens jurídicos para propiciar reciprocamente uma convivência pacífica entre o egresso e a sociedade. Consequentemente, pretende-se reunir três fundamentos sobre os quais a hipótese será traçada: a finalidade preventiva da pena já na sua fase de execução, a reação do indivíduo, por si e coletivamente, e uma filosofia que possa desenvolver a consciência de agir conforme o direito para proteger os bens jurídicos dos demais membros sociais. O paradigma de liberdade escolhido será a filosofia compatibilista, por meio da qual se confirma que a pena pode auxiliar o indivíduo pela função ressocializadora, a fim de que ele próprio molde a sua personalidade e exerça o livre-arbítrio (fundamento da pena) de forma mais compatível com os valores constitucionais. Dependendo de dois aspectos, a virtude técnica e a moral, o Estado fornece elementos que desenvolvem a cidadania do preso ao longo do cumprimento da pena. Esses aspectos devem ser desenvolvidos pelo acesso a direitos sociais com a participação voluntária do reeducando, embora impositiva ao Estado, para que, dentro e fora do sistema penitenciário, o indivíduo possa equilibrar o seu ser e agir em conformidade com a moldura principiológica constitucional, respeitando-se a eficácia dos direitos fundamentais em suas relações sociais. Poderiam esses elementos justificar a necessidade da pena? Sim.
