A presente dissertação debruça-se sobre a figura da produção antecipada de prova, especialmente aquando da sua incidência sobre meios digitais. Numa altura em que a atividade humana se encontra, cada vez mais, transferida para o espaço digital – das comunicações à contratação –, é inevitável que também o processo judicial se encontre diante novas formas de recolha e apreciação da prova. A investigação parte de uma análise geral da noção de prova e das suas várias manifestações, com especial foco na prova documental e digital, procurando compreender em que medida esta última desafia as figuras tradicionais.Reconhecendo que a prova digital se apresenta como especialmente volátil, fragmentada e tecnicamente exigente, o estudo destaca a sua vulnerabilidade face ao decurso do tempo e à perda de integridade, o que justifica, em muitos casos, a necessidade de ser produzida de forma antecipada. Esta antecipação não é meramente uma conveniência processual, mas pode ser essencial para garantir a descoberta da verdade material e assegurar uma decisão justa.A dissertação explora o regime da produção antecipada de prova no ordenamento jurídico português, mas também realiza uma análise comparada com os sistemas do Brasil e de Espanha, detetando nos primeiros uma maior flexibilidade e modernização da figura, nomeadamente com a possibilidade de produção sem necessidade de urgência, visando até fomentar a autocomposição.Sublinha-se a necessidade de ajustar o regime português à realidade atual, não apenas pela exigência técnica da prova digital, mas também para reforçar a celeridade e eficácia da justiça civil. Em sede final, o trabalho propõe uma nova leitura da produção antecipada, mais autónoma e menos dependente de requisitos restritivos, defendendo a consagração de um verdadeiro direito à prova — em particular, digital — como instrumento fundamental de acesso à justiça e de tutela dos direitos das partes.
This dissertation focuses on the concept of early evidence production, especially when it involves digital media. At a time when human activity is increasingly transferred to the digital realm – from communications to contracting – it is inevitable that the judicial process will also face new forms of evidence collection and assessment. The research begins with a general analysis of the concept of evidence and its various manifestations, with a special focus on documentary and digital evidence, seeking to understand the extent to which the latter challenges traditional models.Recognizing that digital evidence is particularly volatile, fragmented, and technically demanding, the study highlights its vulnerability to the passage of time and loss of integrity, which in many cases justifies the need for early evidence gathering. This early evidence is not merely a procedural convenience, but can be essential to ensuring the discovery of the material truth and ensuring a fair decision. This dissertation explores the regime of early evidence gathering in the portuguese legal system, but also conducts a comparative analysis with the systems in Brazil and Spain. It finds greater flexibility and modernization in the former, particularly with the possibility of production without the need for urgency, even with a view to fostering self-composition.The need to adapt the Portuguese regime to the current reality is emphasized, not only due to the technical demands of digital evidence, but also to strengthen the speed and effectiveness of civil justice. Finally, the work proposes a new interpretation of early evidence, one that is more autonomous and less dependent on restrictive requirements, advocating for the establishment of a true right to evidence – especially digital evidence – as a fundamental instrument for access to justice and the protection of the rights of the parties.
