O bem jurídico nos crimes de corrupção no setor privado

Abstract

A presente investigação procura determinar se existe um bem jurídico-penal capaz de legitimar a incriminação da corrupção no setor privado no ordenamento jurídico português ou se, pelo contrário, a mesma padece de um vício de inconstitucionalidade material, seja por impossibilidade de identificação de um bem jurídico apto a cumprir a função de padrão crítico que a doutrina lhe reconhece, ou por violação dos princípios da dignidade penal da conduta e da necessidade ou carência de tutela.Para o efeito, em primeiro lugar, procuraremos estabelecer os contornos do movimento criminalizador destas condutas, entendidas como corrupção à luz da estrutura tripartida avançada pela teoria “principal-agente”, analisando os principais instrumentos europeus e internacionais, bem como as respetivas incriminações portuguesas, atualmente positivadas nos artigos 8.º e 9.º da Lei n.º 20/2008, que dele são reflexo, sublinhando, por fim a tendencial harmonização que se tem verificado quanto os principais ordenamentos jurídicos europeus nesta matéria.De seguida, faremos um breve percurso pela questão em torno da função do direito penal, em geral, enquanto tutela subsidiária de bens jurídico-penais, e, em particular, no contexto dos desafios colocados pela reclamação de tutela pelos membros da sociedade face aos grandes riscos que atualmente a ela são inerentes, dando particular ênfase à teoria dos bens jurídicos coletivos ou universais.Por fim, debruçar-nos-emos sobre os principais modelos teóricos de criminalização da corrupção no setor privado, a partir dos quais confrontaremos as normas portuguesas, a fim de determinar se estamos, ou não, perante criminalizações proporcionais, necessárias e eficazes, ou se, pelo contrário, estas são exemplo de uma expansão irrazoável, e inconstitucional à luz da Constituição da República Portuguesa, do direito penal, reduzindo-o a um mero símbolo de “combate” a esta “suposta” criminalidade.

The following research seeks to determine whether there is a legal-penal interest capable of legitimising the incrimination of corruption in the private sector in the Portuguese legal system or whether, on the contrary, it is materially unconstitutional, either because it is impossible to identify a legal interest capable of fulfilling the function of a critical standard, which legal scholars have long recognised, or because it violates the principles of the criminal dignity of conduct or the need or lack of protection.To this end, firstly, we will try to establish the contours of the criminalisation movement of these conducts, understood as corruption in the light of the tripartite structure put forward by the ‘principal-agent’ theory, analysing the main European and international instruments, as well as the respective Portuguese incriminations, currently enshrined in articles 8 and 9 of Law 20/2008, which reflect this, finally highlighting the tendency towards harmonisation that has occurred in the main European legal systems in this area.Next, we'll take a brief look at the role of criminal law in general as a subsidiary protection of criminal legal assets, and in particular in the context of the challenges posed by the demand for protection by members of society in the face of the great risks that are currently inherent to it, with particular emphasis on the theory of collective or universal legal assets.Finally, we shall look at the main theoretical models for criminalising corruption in the private sector, from which we will compare the Portuguese rules in order to determine whether or not we are dealing with proportional, necessary, and effective criminalisations, or whether, on the contrary, these are examples of an unreasonable, and unconstitutional under the Constitution of the Portuguese Republic, reducing it to a mere symbol of ‘combating’ this ‘supposed’ criminality.
