A presente dissertação tem como objeto o estudo do consentimento informado, enquanto instituto central na relação médico-paciente, e sua análise à luz da jurisprudência nacional e internacional. Partindo da sua evolução histórica e conceptual, a análise percorre os marcos jurisprudenciais internacionais que moldaram a atual compreensão deste direito, com especial destaque para a jurisprudência anglo-saxónica. Na segunda fase, analisam-se os elementos essenciais para a validade do consentimento informado: a capacidade do paciente, a informação adequada e a voluntariedade na decisão. Abordam-se também as exceções que permitem agir sem consentimento, procurando um equilíbrio entre a proteção da autonomia e a salvaguarda da vida e da saúde. Esta análise ajuda a clarificar os limites e condições do consentimento, destacando o seu papel fundamental na relação médicopaciente. A terceira parte é dedicada à análise de jurisprudência do Tribunal Europeu dos Direitos do Homem. Perante a ausência de mecanismos jurisdicionais internacionais que assegurem a responsabilização dos Estados por incumprimento das disposições contidas na Convenção de Oviedo, incumbe ao TEDH a afirmação e tutela dos direitos e princípios nela consagrados. À luz do artigo 8º da Convenção Europeia dos Direitos Humanos tem reconhecido que a ausência de consentimento informado e a prestação de cuidados médicos sem a adequada informação, pode constituir uma violação do direito ao respeito pela vida privada. A dissertação articula a teoria do consentimento informado com a sua aplicação na jurisprudência, mostrando que é uma exigência legal que legitima a intervenção médica, refletindo o princípio da dignidade humana. É um direito protegido tanto pelo direito interno como pelo sistema europeu de direitos humanos.
This dissertation focuses on the study of informed consent as a central institution in the doctor-patient relationship, analyzing it in light of national and international jurisprudence. Starting from its historical and conceptual evolution, the analysis reviews the key internacional jurisprudential milestones that have shaped the current urderstanding of this right, with particular emphasis on anglo-saxon case-law. In a second phase, the essencial elements for the validity of informed consent are analyzed: the patient’s capacity, adequate information, and voluntariness in decision-making. Exceptions allowing actions without consent are also addressed, seeking a balance between protecting autonomy and safeguarding life and health. This analysis helps clarify the limits and conditions of consent, highlighting its fundamental role in the doctor-patient relationship. The third part is dedicated to the analysis of case law of the European Court of Human Rights. Faced with the absence of international jurisdictional mechanisms that ensure the accountability of States for breaches of the provisions contained in the Oviedo Convention, it is incumbent upon the ECtHR to affirm and safeguard the rights and principles enshrined therein. In light of article 8 of the European Convention on Human Rights, it has recognized that the absence of informed consent and the provision of medical care without adequate information may constitute a violation of the right to respect for private life. The dissertation connects the theory of informed consent with its application in case law, showing that it is a legal requirement that legitimizes medical intervention, reflecting the principle of human dignity. It is a right protected both under domestic law and the European human rights system.
