Abstract

A outorga do Tratado do Atlântico Norte e a criação da Organização nele projetada em 1949, tiveram como pretexto a garantia da segurança coletiva dos seus Estados-membros em virtude do quadro geopolítico da segunda metade do século XX, caracterizado pela crescente tensão entre os blocos este e oeste no âmbito da Guerra Fria. Concomitantemente, o fenómeno da humanização do Direito Internacional Público, cujo estopim foram as consequências da Primeira e Segunda Guerras Mundiais, veio privilegiar o Humano em relação aos remanescentes sujeitos do Direito Internacional. O desenrolar da História fez cumprir a missão inicial do Tratado com o final da Guerra Fria em 1989. Neste cenário, problematizou-se o futuro do domínio da atuação desta Organização no plano internacional. Estas duas matérias cruzam-se quando a Organização do Tratado de Atlântico Norte determina que a sua ação deverá passar a ser voltada para a proteção dos Direitos Humanos, mesmo que os Estados vítima não sejam parte do Tratado. Este comportamento implica o confronto entre determinados princípios jurídicos de índole internacional e relevantes figuras de Direito Internacional Público, especialmente a figura da intervenção humanitária. A presente dissertação pretende, portanto, fazer uma análise da legalidade, legitimidade e eficácia das intervenções humanitárias, através do estudo das operações praticadas neste âmbito pelos países da Organização do Tratado do Atlântico Norte no Kosovo, no Afeganistão, no Iraque e na Líbia. The granting of the North Atlantic Treaty and the creation of the Organization projected therein in 1949 had as pretext the guarantee of the collective security of its member States, due to the geopolitical framework of the second half of the 20th century, characterized by the growing tension between the east and west blocs in the context of the Cold War. Concomitantly, the phenomenon of the humanization of Public International Law, which was triggered by the consequences of the Second World War, gave priority to the Human being in relation to the remaining subjects of International Law. As History unfolded, the Treaty's initial mission was fulfilled with the end of the Cold War in 1989. In this context, the future of the Organization's field of action on the international stage was questioned. These two topics intersect when the North Atlantic Treaty Organization determines that its actions should be geared towards the protection of Human Rights, even if the victim States are not party to the Treaty. This behavior implies a confrontation between certain legal principles of international nature and relevant figures of Public International Law, especially the figure of humanitarian intervention. This dissertation therefore aims to analyze the legality, legitimacy and effectiveness of humanitarian interventions by studying the operations carried out within this scope by the North Atlantic Treaty Organization countries in Kosovo, Afghanistan, Iraq and Libya.
