Abstract

O presente trabalho objetiva fornecer uma análise crítico‑reflexiva de duas dimensões, ligadas à liberdade religiosa, que frequentemente operam como causas do influxo massivo de refugiados. Trata‑se de explorar fatores ou elementos, presentes na ordem política ou jurídica de alguns países, que impulsionam o deslocamento forçado, com vistas a prover elementos densificadores, comumente não observados mas potencialmente aplicáveis na resposta da comunidade internacional. O primeiro domínio é a aplicação das “leis de blasfêmia”. O segundo é a utilização da religião como facilitadora da concessão de cidadania. Situado dogmaticamente na interseção entre os regimes do Direito Internacional dos Direitos Humanos (DIDH) e Direito Internacional dos Refugiados (DIR), o trabalho busca examinar se essas duas tendências normativas constituem limitações permissíveis à liberdade religiosa, no quadro do DIDH, ou se há suficientes razões para afirmar que constituem “perseguição com base na religião” para efeitos de aplicação do DIR.
