A study on the punishment dealt to the crimes of active and passive specifically corruption through the lens of the goals of punishment in general in the portuguese legal system, its aims, goals and needs in modern society. A study that will begin in the historical context of said crime, how it developed through time, followed by a study of the legal interest that is actually protected by crmiminalizing these conducts, a study of the crime itself and its characteristics, a study of how suspended sentences work in abstract and then finally the aplication of suspended sentences in cases of corruption. In the context of current society it is understood that the crime of corruption has been increasingly more newsworthy at the same time as we also understand a greater sensibility and necessity for the application of justice desired by the citizen to the practice of these illicit actions so damaging to the regular function of the state and society in generalCentered therefore on the crime of corruption the present dissertation will study and analyze not just the practice of these illicit acts in all their aspects, their characterization, the legal interest that they offend and its consequences, but also its punishment in the portuguese legal system while also looking at its evolution throughout time, evaluating and comparing the functions of punishment in general in the legal system with the way that this crime is punished and assessing if that punishment fulfills the needs of justice and of protection of the legal interest protected by criminalizing acts that substantiate the crime of corruption.

Um estudo da punição legal em casos de corrupção ativa e passiva especificamente através da ótica das finalidades da punição em geral no ordenamento jurídico português, os objetivos a cumprir com essa punição e as necessidades a ela inerentes. Este estudo começara com um breve contexto histórico, a evolução da corrupção ao longo do tempo, seguido do estudo do bem jurídico protegido pela criminalização destas condutas, um estudo do crime de corrupção em si, as suas características, uma análise da pena suspensa em abstrato e finalmente a aplicação dessa pena suspensa em casos de corrupção. No contexto da sociedade atual percebemos que o crime de corrupção tem vindo cada vez mais a assumir uma vertente mediática ao mesmo tempo que também percebemos uma maior sensibilidade e necessidade da aplicação da justiça desejada pelo cidadão à prática destes atos ilícitos tão perturbadores a um normal funcionamento do Estado e da sociedade em geral.Centrado por isso no crime de corrupção a presente dissertação irá estudar e analisar não só a prática de atos destes atos ilícitos em todas as suas vertentes, a sua caracterização, o bem jurídico que este ofende e as suas consequências, como também a sua punição no ordenamento jurídico português olhando também para a sua evolução ao longo do tempo, avaliando e contrapondo os objetivos da punição em geral no ordenamento jurídico com a forma como este é punido e verificando se essa punição satisfaz as necessidades de justiça e de proteção do bem jurídico protegido pela criminalização de atos que consubstanciam o crime de corrupção.
