Abstract

The here presented dissertation aims to analyse the current nature of the crime of rape, as foreseen and punishable under the 164º article of the penal code, and reflect from a perspective of protecting the interests of the victim, on the best legislative path to follow, considering that several proposed amendments to the law have been raised, especially since 2014.To achive the aforementioned objective, it will be important on a first instance, to understand the procedural evolution of the offense in question, from 1852 - the approval date of the first portuguese penal code - to the present day, noting the main changes that have led to its current semi-public nature.Subsequently, as it would not make sense to discuss its nature without dissecting its content, a brief but highly important analysis of the legal type of the crime of rape will be provided - its elements, means of execution, and protecter legal interests.In a third phase, we are now in a position to discuss the current regime in force: the semi-public nature -which grants the victim alone the possibility of filing a complaint - and its exceptions, as provided in paragraph 2 of article 178 of the penal code, which appears to be highly relevant.With that said, we will consider some of the arguments and issues raised in the discussion between the dichotomy of public vs. semi-public nature, focusing particularly on the effects and implications that a criminal process can have on the life and personality of the victim.Finally, we will conclude on the relevance - of lack thereof - of changing the nature of the legal type in question, and if not, the improvement and enhancement of the current regime.

A Dissertação que ora se vos apresenta tem por objetivo a análise da atual natureza do crime de Violação, previsto e punível pelo artigo 164.º do Código Penal, e, bem assim, a reflexão, sob o ponto de vista de proteção do interesse da vítima, de qual o melhor caminho legislativo a percorrer, dado já várias propostas de alteração da lei se terem levantado, sobretudo desde 2014. Para lograr o mencionado objetivo, importará, num primeiro momento, conhecer a evolução processual do ilícito em causa, no período compreendido entre 1852 – data de aprovação do primeiro Código Penal Português – até aos dias de hoje, notando as principais alterações produzidas conducentes à atual natureza semipública. Posteriormente, porquanto não faria sentido discorrer sobre a sua natureza sem dissecar o seu conteúdo, faremos uma análise breve, mas de elevada importância, do tipo legal de crime Violação – os seus elementos, meios de execução e bem jurídico protegido.Num terceiro momento, encontramo-nos já em condições de discorrer sobre o atual regime em vigor: a natureza semipública – que confere apenas à vítima a possibilidade de apresentação de queixa – e as suas exceções, previstas no n.º 2 do artigo 178.º CP, que bem pertinentes nos parecem.Posto isto, trazemos à reflexão alguns dos argumentos e problemas mobilizados na discussão entre a dicotomia natureza pública vs semipública, incidindo em particular os efeitos e implicações que um processo penal pode trazer à vida e personalidade da vítima.Por último, concluiremos sobre a pertinência – ou não – de alteração da natureza do tipo legal em causa e, se não, o aperfeiçoamento e aprimoramento do atual regime.
