Abstract

A presente dissertação subdivide-se em dois grandes temas centrais.Num primeiro momento, trataremos de aprofundar o bem-estar dos animais não- humanos, começando por fazer um breve enquadramento histórico, no âmbito do Direito Internacional e Europeu. De seguida, o nosso objeto de estudo incidirá sobre o estatuto dos animais não-humanos no ordenamento jurídico português, no âmbito do Direito Civil, analisando a sua evolução histórica (dando especial atenção às alterações introduzidas pela Lei n.º 8/2017 de 3 de março, no Código Civil vigente).O segundo grande tema centra-se na Tauromaquia (atividade lúdica na qual os touros de lide e cavalos participam), explorando o enquadramento histórico a nível Europeu e no âmbito do Direito Comparado (com a Tauromaquia em Espanha e Sul de França).Seguidamente, analisar-se-á a Tauromaquia em Portugal e suas características. Concluindo o tema com o desenvolvimento da principal problemática em causa: visão de “Direito ou Cultura?”. This essay can be divided into two major topics.Firstly, we will approach the non-human animals well- being by presenting an historical background, concerning International and European Laws. Then, our purpose will be to analyse the status of non-human animals, by studying its historical evolution (highlighting the changes introduced by the Law n.o 8/2017 in the present Civil Law).Secondly, we will focus in Bullfighting (traditional riding activity in wich bulls and horses participate) by exploring the historical European framework and Comparative Law (in Bullfigting both in Portugal and Spain).After that we will approach Bullfighting in Portugal and its features.
