Abstract

O presente trabalho tem por objetivo o estudo por admissibilidade da prova ilícita em Direito Processo Civil. Apesar dos avanços introduzidos no Código de Processo Civil com a Lei n. º41/2013, de 26 de Junho, continuam a existir diversas dúvidas no que concerne à prova ilícita e à sua admissibilidade no nosso ordenamento jurídico. Estas dúvidas são visíveis, desde logo, na doutrina e na jurisprudência que não estão em unanimidade quanto à prova ilícita e a sua consequente admissibilidade e valoração. Neste sentido, este trabalho aborda as diferentes teses e doutrinas em torno da temática da prova, com vista a encontrar uma solução equilibrada que consiga tratar o problema sem nunca perder de vista direitos constitucionalmente consagrados e também a descoberta da verdade material. Neste trabalho abordámos ainda o problema da prova ilícita no direito processual penal que, desde logo, se encontra resolvido com a consagração do preceito do artigo 32.º n.º 8 da CRP em conjugação com as normas do CPP. Tal não se encontra resolvido no CPC e, como veremos, há diferentes teses que defendem como se deveria resolver este problema, seja pela aplicação analógica do preceito constitucional mencionado seja pela análise de caso a caso. Muitas são as vozes na doutrina e jurisprudência a favor das teorias contra a admissibilidade da prova ilícita, no entanto, com esta exposição da temática, propomos seguir-se um caminho mais ponderado e menos radical. Desta nforma, propomos o seguinte trabalho baseado em diversas fontes bibliográficas, assim como na jurisprudência.

The present work aims to study the admissibility of illegal evidence in Civil Procedure Law. Despite the advancements made in the Code of Civil Procedure by Law n. º 41/2013, of June 26 , there are still several concerns regarding illegal evidence and its admissibility in our legal system. These reservations are immediately visible in the doctrine and jurisprudence that are not unanimous regarding the illegal evidence and its admissibility and assessment. In this sense, this work addresses the various thesis and doctrines surrounding the subject of proof, in order to find a balanced solution that manages to deal with the problem while never losing sight of constitutionally enshrined rights and the discovery of material truth. In this work, we also addressed the issue of illegal evidence in criminal procedural law in this work, which is immediately resolved with the enshrinement of the precept of article 32.º n. º 8 of the CRP in conjunction with the CPP rules. This is not resolved in the CPC and, as we will see, there are different thesis that defend how this problem should be resolved, either through analogical application of the mentioned constitutional precept or through a case-by-case analysis. There are many voices in doctrine and jurisprudence in favor of theories against the admissibility of illegal evidence, however with this exposition of the theme we propose to follow a more thoughtful and less radical path. In this way, we propose the following work based on several bibliographic sources, as well as on jurisprudence.
