Abstract

O crime de branqueamento de capitais desde a sua génese que procura combater as vantagens obtidas ilicitamente com a prática de ilícitos típicos que lhe estão associados. Se aquando da sua primeira incriminação internacional estava umbilicalmente ligado ao tráfico de estupefaciente e substâncias psicotrópicas, atualmente, assiste-se a uma expansão sem precedentes do tipo do ilícito do crime de branqueamento, nomeadamente, o universo dos factos precedentes, condição objetiva de punibilidade. Ao longo desta dissertação, pretendeu-se analisar a relação entre o crime de branqueamento e o facto precedente que lhe está, necessariamente, subjacente, e as problemática daí derivadas. Para isso, partimos da análise da evolução legislativa europeia e internacional, por forma a compreender a evolução do tipo. Debruçamo-nos sobre qual o bem jurídico tutelado, considerando a sua função de fundamentação de ilicitude e enquanto critério de interpretação e construção do tipo. Analisamos a construção legal do tipo de branqueamento, o tipo objetivo e subjetivo de ilícito e as suas particularidades. Refletimos sobre as alterações causadas no tipo legal pela entrada em vigor da Lei n.º 58/2020, de 31 de agosto, em resultado da transposição da Diretiva (UE) 2018/1673, relativa ao combate ao branqueamento através do direito penal. Por fim, cogitamos sobre a natureza dos ilícitos típicos, os critérios estabelecidos para a sua tipificação na lei penal portuguesa e as problemática suscitadas a nível de consunção ou concurso de crimes.

Since its origin, the crime of money laundering has sought to combat the advantages illicitly obtained through the practice of predicate offences associated with it. If at the time of its first international incrimination it was umbilically linked to drug and psychotropic substance trafficking, currently, we are witnessing an unprecedented expansion of the type of illicit crime of money laundering, namely, the universe of precedent facts, an objective condition of punishment. Throughout this dissertation, we intended to analyze the relationship between the crime of money laundering and the precedent fact that necessarily underlies it, and the problems derived therefrom. To do so, we started by analyzing the European and international legislative evolution, in order to understand the evolution of the type. We focus on the legal interest protected, considering its function as a basis of illicitness and as a criterion of interpretation and construction of the type. We analyze the legal construction of the laundering type, the objective and subjective type of offence, and its particularities. We reflect on the changes caused in the legal type by the entry into force of Law no. 58/2020, of 31 August, as a result of the transposition of (EU) Directive 2018/1673, on combating laundering through criminal law. Finally, we consider the nature of the typical offences, the criteria established for their typification in Portuguese criminal law, and the problems raised at the level of consensual or concurrent crimes.
