Abstract

Apesar de a convivência com os direitos fundamentais ser uma realidade já experimentada em considerável parte do planeta e de todos os esforços, normativo e hermenêutico, para sua consolidação, sua violação também é uma realidade igualmente conhecida em diferentes Estados Democráticos e Sociais de Direito, independentemente das características econômicas, sociais ou culturais que possuam. Seja por intermédio de atos entre particulares, seja através de atos do Poder Público, os direitos humanos, traduzidos em direitos fundamentais, são vilipendiados em distintas proporções. Diante de um cenário de profunda violação aos direitos fundamentais, buscam-se possíveis respostas de correção e superação. Nesse contexto, é objetivo do presente trabalho estudar e analisar um mecanismo processual de solução de litígios estruturais em matéria constitucional, inaugurado pela Corte Constitucional Colombiana: o Estado de Coisas Inconstitucional. A partir de uma pesquisa bibliográfica e documental de obras especializadas que circundam o tema, o trabalho se propõe a compreender o conceito, as características, os requisitos e os esforços dogmáticos construídos para justificar a intervenção judiciária estrutural nos desvios da condução de políticas públicas, considerados inconstitucionais, bem como realizar um estudo comparativo entre a teoria e a prática constitucional-processual. Buscou-se possíveis respostas que visam à conferência de legitimidade do instituto, além de predicados procedimentais capazes de tornar o mecanismo um verdadeiro e legítimo instrumento de salvaguarda dos direitos fundamentais, sem que se inaugure ou fortaleçam problemas internos na relação entre os Poderes.

Although living with fundamental rights is a reality already experienced in a considerable part of the planet and despite all the efforts, normative and hermeneutic, for its consolidation, its violation is also a reality equally known in different Democratic and Social States of Law, regardless of the economic, social or cultural characteristics they possess. Whether through acts between individuals or acts of the Government, human rights, translated into fundamental rights, are vilified in different proportions. Faced with a profound violation of the fundamental rights scenario, we seek possible responses to correction and overcoming. In this context, the objective of the present work is to study and analyze a procedural mechanism for solving structural disputes in constitutional matters, inaugurated by the Colombian Constitutional Court: the Unconstitutional State of Things. From bibliographical and documentary research of specialized works that surround the subject, this work proposes to understand the concept, the characteristics, the requirements, and the dogmatic efforts built to justify the structural judicial intervention in the deviations of the conduction of public policies, considered unconstitutional, as well as to carry out a comparative study between the theory and the constitutional-procedural practice. We seek possible answers to verify the legitimacy of the institute, in addition to procedural predicates capable of making the mechanism a genuine and legitimate instrument for safeguarding fundamental rights without opening or strengthening internal problems in the relationship between the Powers.
