Abstract

O presente trabalho tem como objetivo analisar a arbitragem internacional, demonstrando suas particularidades, principalmente, no que concerne à sua internacionalidade e às questões que envolve a escolha da sede da arbitragem. Desse modo, a análise do instituto da arbitragem internacional será dividida em três partes com objetivo de fornecer uma melhor perspectiva e conhecimento sobre a arbitragem maneira de geral, para, depois, com essas informações, adentrarmos a análise da complexidade que a arbitragem internacional acarreta no mundo jurídico e social. Na primeira parte, iremos discorrer sobre o instituto da arbitragem de forma geral, discorrendo sobre seus principais elementos como: seu conceito e noções iniciais, a conceituação da convenção de arbitragem, como compromisso arbitral ou cláusula arbitral, avançando para a problemática caracterização da sua natureza jurídica, desenvolvendo as quatro teorias: contratualista, jurisdicionalista, mista e autonomista.No capítulo seguinte, tratamos, especificamente, do foco do trabalho, a arbitragem internacional. Abordaremos suas principais características: conceituação, importância no comércio internacional, seu enquadramento em alguns ordenamentos jurídicos, seus critérios caracterizadores de internacionalidade, com ênfase nos dispostos na Lei-Modelo da UNCITRAL e a Convenção de Nova Iorque de 1958. Na última parte, abordaremos, então, a relevância da lei da sede de arbitragem na arbitragem internacional, sob a ótica de três teses: territorialista, autônoma e pluralista. A primeira considerada a mais clássica e as demais oferecendo um contraponto a seus argumentos. Por fim, levando em conta os conceitos e discussões aventadas, pretendemos oferecer nossa contribuição, indicando qual a tese, atualmente, entendemos ser a mais favorável a um desenvolvimento da arbitragem internacional.

The present dissertation aims to analyze international arbitration, demonstrating its particularities, mainly with regard to its internationality and the issues surrounding the choice of the seat of arbitration. In this way, the analysis of the institute of international arbitration will be divided into three parts in order to provide a better perspective and knowledge about arbitration in general, so that, later, with this information, we can enter the analysis of the complexity that international arbitration entails in the legal and social world.In the first part, we will discuss the arbitration institute in general, discussing its main elements such as: its concept and initial notions, the conceptualization of the arbitration agreement, as an arbitration agreement or arbitration clause, advancing to the problematic characterization of its juridical nature, developing the four theories: contractualist, jurisdictionalist, mixed and autonomist. In the following chapter, we deal specifically with the focus of the work, international arbitration. We will address its main characteristics: conceptualization, importance in international trade, its framework in some legal systems, its criteria for characterizing internationality, with emphasis on the provisions of the UNCITRAL Model-Law and The 1958 New York Convention. Then, the relevance of the law of the seat of arbitration in international arbitration, from the perspective of three theses: territorialist, autonomous and pluralist. The first considered the most classic and the others offering a counterpoint to their arguments. Finally, taking into account the concepts and discussions raised, we intend to offer our contribution, indicating which thesis, currently, we believe to be the most favorable to the development of international arbitration.
