The invitation is to study modern civil procedure and the desirable protection of vulnerable subjects, especially the terminally ill – in the case of the latter by means of an injunction, ex officio decreed by the court.We will begin by explaining the importance of the transition from the formalist idea to a conception embedded with ethical, constitutional, and fair values.It is from this change of panorama that the idea of the judge as a conductor of the process emerges, in accordance with a principle of pro actione management.Throughout the dissertation, we keep in mind the modern Democratic State and the fair composition of the litigation as a guide.Having said this, we will start investigating the vulnerable procedural subject and the reasons for this vulnerability, with emphasis on terminal illness.We will look at the concept of the terminally ill and the risks that they run in the slow process that disturbs material justice.Next, we address injunctive relief, its nature, modalities, purposes, characteristics, and requirements for its decree.As well as ex officio injunctive relief, beginning with the analysis of the regimes that diffuse it in the Portuguese legal system.Then we ask whether it is, or should be, under the material management powers of the anti-formalist judge, to adjust the process ex officio to the reality of the concrete case, make use of the remedy that is the injunction and, consequently, effectively decide the conflict of interests.Our answer is affirmative, therefore we will elaborate and justify in this sense, to finally suggest a legislative introduction that will consecrate the themes explained in this journey.

O convite é a um estudo sobre o processo civil moderno e a desejável tutela do sujeito vulnerável, em especial do doente terminal – quanto a este através da providência cautelar, oficiosamente decretada pelo tribunal.Começaremos por explanar a importância da transição da ideia formalista para uma conceção embebida de valores éticos, constitucionais e justos.É desta mudança de panorama que emerge a ideia do juiz como condutor do processo, concordante com um princípio de gestão pro actione.Ao longo de toda a dissertação temos presente o moderno Estado Democrático e como guia a justa composição do litígio.Posto isto, partiremos a investigar o sujeito processual vulnerável e as razões desta vulnerabilidade, com ênfase na doença terminal.Debruçamo-nos sobre o conceito de doente terminal e sobre os riscos que este corre no processo vagaroso inquietador da Justiça material.Em seguida, cabe abordar a tutela cautelar, a sua natureza, modalidades, finalidades, características e requisitos de decretamento.Bem como a tutelar cautelar oficiosa, principiando pela análise dos regimes que a difunde no ordenamento jurídico português.Para então interrogar se está, ou deve estar, ao abrigo dos poderes de gestão material do juiz anti-formalista, adequar oficiosamente o processo à realidade do caso concreto, fazer uso do remédio que é a providência cautelar e, consequentemente, decidir efetivamente o conflito de interesses.A nossa resposta é afirmativa, por conseguinte elaboraremos e fundamentaremos nesse sentido, para a final sugerir uma introdução legislativa consagradora dos temas explanados nesta jornada.
