[ES] El derecho de asilo o inmunidad del sagrado llegó al Nuevo Mundo en 1494 con el proyecto evangelizador planteado por la Corona y la Iglesia, y se mantuvo vigente hasta 1865, aunque con interrupciones. A pesar de los privilegios que obtuvo la Corona con el Patronato Real, la iglesia trató de mantener la autoridad en sus espacios y la libertad de otorgar asilo a quien consideraran que se lo merecía, sin importar la opinión y el deseo real ni del gobierno local. Pero no siempre lo logró ya que el gobierno español se impuso muchas veces en contra de la iglesia, extrayendo personas de su interior para ser juzgada. A pesar de ello, los recintos religiosos siguieron jugando un rol muy importante para la población de Santo Domingo, que encontró en ellos un espacio de refugio, amparo y donde eludir a la justicia civil durante el período de dominación española. Por tal motivo el objetivo de este estudio es mostrar la lucha entre la Iglesia y las instituciones gubernamentales por controlar y hacer valer el derecho a asilo o refugio eclesiástico en la isla de Santo Domingo vista desde el aspecto histórico y tomando en cuenta ciertas normas canónicas que iban surgiendo paralelamente a los hechos.
[EN] The right of asylum or immunity of the sacred arrived in the New World in 1494 with the evangelizing project proposed by the crown and the Church, and remained in force until 1865, although with interruptions. Despite the privileges that the crown obtained with the Patronato Real, the church tried to maintain authority in its spaces and the freedom to grant asylum to whoever they considered deserved it, regardless of the Royal opinion and desire or of the local government. But it did not always succeed, since the Spanish government prevailed many times against the church, extracting people from within it to be judged. Despite this, the religious sites continued to play a very important role for the population of Santo Domingo, who found in them a space of refuge, protection and where they could elude civil justice during the period of Spanish domination. For this reason, the objective of this study is to show the struggle between the Church and government institutions to control and enforce the right to asylum or ecclesiastical refuge on the island of Santo Domingo seen from the historical aspect and considering certain canonical norms that were emerging parallel to the events.
