Abstract

Treball final de Grau en Criminologia i Seguretat. Codi: CS1044. Curs acadèmic 2014-2015 Para la realización de este trabajo de investigación se estudió la parte referente al objeto del proceso del libro Derecho Jurisdiccional III, el cual se estudia en la Universidad Jaime I como referencia principal en esta materia. A partir de aquí se realizó un estudio de diferentes autores y vertientes para poder llegar a determinar, desde el punto de vista del autor, como se forma o construye el objeto material del proceso penal y civil acumulado. Esto significa que primero se determinó la importancia del objeto en el proceso, acto seguido se pasó a definir cuales eran los elementos identificadores del objeto material, en cuyo caso se desestimó la calificación jurídico-penal por su papel no relevante a la hora de definir éste, puesto que son el hecho criminal imputado, el hecho ilícito cometido en el espacio y el tiempo que desencadena el proceso, y la persona acusada, aquella sobre la que recaerá el 5 proceso, los elementos que verdaderamente van a definir la pretensión penal. Se realizó también un estudio sobre la litispendencia y la problemática que supone la determinación de en qué momento se da la interrupción de la prescripción. Por último se estudió la acumulación del proceso civil al proceso penal en los casos en los que la Ley lo permite, es aquí donde surgió la última controversia sobre si dicha acumulación llega a ser beneficiosa para el Estado o no, puesto que se entiende que para la víctima si lo es por el ahorro de tiempo al no tener que constituirse parte en dos procesos. Finalmente se redactaron una serie de conclusiones que vienen a reflejar como entiende el autor de dicho trabajo las controversias descritas en los párrafos anteriores. To carry out this research part of the process relating to the object of the book III Jurisdictional Law, which is studied in the Jaime I University as the main reference in this matter was studied. From here a study of different authors and springs are made to be able to determine, from the point of view of the author, as it is formed or build material subject to criminal and civil process accumulated. This means that first the importance of the object in the process thereupon went on to define what were the material object identifiers, in which case the criminal legal qualification for its important role not dismissed when it was determined defining , since they are the accused criminal act, the wrongful act in space and time that triggers the process and the person charged, the one on which it falls the process, elements that truly will define the criminal claim. A study on lis pendens and the problems posed by the determination of when the interruption of the limitation occurs was also performed. Finally accumulation civil trial studied the criminal proceedings in cases where the law permits, is where the latest controversy over whether such accumulation becomes beneficial for the state or did not arise, since it is understood that for the victim if it is by saving time by not having to become part of two processes. Finally some conclusions that come to reflect and understand the author of such work disputes described in the preceding paragraphs were drafted.
