El papa recién nombrado, monseñor Bergoglio, ha tomado el nombre de Francisco, parece que en homenaje a Francisco de Asís, símbolo de la pobreza. En este trabajo se ofrecen algunas claves para comprender el papel decisivo de la llamada «controversia sobre la pobreza evangélica» que promovieron los franciscanos. Se estudia el concepto de Derechos Humanos, a partir del Derecho subjetivo. Guillermo de Ockham define el derecho como facultas o potestas, conclusión por reducción al absurdo de la defensa del privilegio de la pobreza máxima: no poseer ningún derecho.
The recently named pope, Monsignor Bergoglio, has taken the name Francis, apparently after St. Francis of Assisi, symbol of poverty. In this paper some clues are proposed to understand the decisive role of the so called “controversy over evangelical poverty” promoted by the Franciscans. It is studied the concept of Human Rights taking as starting point the Subjective Right. William of Ockham defines Law as facultas or potestas, which is the conclusion by reduction to the absurd of the defense of the maximum poverty privilege: possessing no rights.
