Delitos de odio por discriminación religiosa

Abstract

Los principios de igualdad y no discriminación constituyen una expresión esencial de la dignidad inherente a toda persona. Entendida ésta como el respeto y la valoración intrínseca que corresponde a todo individuo por su simple condición humana y que le permite el desarrollo de su personalidad y libre identificación, así como su concepción de vida; constituye un bien jurídico fundamental que requiere especial protección. Por ello, el Código Penal ha tipificado el delito de odio para sancionar todo tipo de actuaciones delictivas motivadas por prejuicios. En este caso, nos centraremos en los delitos de odio por discriminación religiosa, haciendo un análisis desde las posturas del TEDH, el TC español y la Fiscalía General del Estado. Pasando por último por centrarnos en específico en los delitos de odio anticristianos, antisemitas y contra los Musulmanes.
