Eficacia civil del matrimonio religioso

Abstract

El Estado español reconoce efectos civiles a los matrimonios celebrados en forma religiosa. En un principio solo se reconocían efectos civiles al matrimonio canónico, suscribiendo el Acuerdo sobre Asuntos Jurídicos con la Santa Sede en 1979. En el año 1992, el Estado firma acuerdos de cooperación con otras confesiones religiosas: con la Federación de Entidades Religiosas Evangélicas de España, con la Federación de Comunidades Judías de España y con la Comisión Islámica de España. Finalmente, con la aprobación de la Ley 15/2015, de Jurisdicción Voluntaria, se aumenta el número de confesiones religiosas a las que se reconocen sus matrimonios siempre que hayan conseguido la declaración de notorio arraigo. Estas confesiones son: Testigos de Jehová, Iglesia de Jesucristo de los Santos de los Últimos Días (mormones), Federación de Comunidades Budistas de España y la Iglesia Ortodoxa

The Spanish State recognizes civil effects for matrimonies celebrated in a religious way. At first, civil effects were only recognized for canonical marriage, signing the Legal Affairs Agreement with the Holy See in 1979. In 1992, the State signed collaboration agreements with other religious confessions: with the Federation of Religious Evangelical Entities of Spain, with the Federation of Jewish Communities of Spain and the Islamic Commission of Spain. Finally, with the approval of Law 15/2015, of Voluntary Jurisdiction, the number of religious confessions to which their marriages are recognized is increased as long as they have obtained the declaration of notorious roots. These confessions are: Jehovah's Witnesses, Church of Jesus Christ of Latter-day Saints (Mormons), Federation of Buddhist Communities of Spain and the Orthodox Church.
