Si se tiene en cuenta el reconocimiento de la Constitución española, de que todos tenemos derecho al trabajo, este estudio tiene como eje central analizar la normativa, doctrina y jurisprudencia que hay al respecto, en lo relativo a la compatibilidad o incompatibilidad de las pensiones por incapacidad permanente con el trabajo remunerado, ya sea por cuenta ajena o por cuenta propia. El papel del Instituto Nacional de la Seguridad Social es fundamental, porque puede convertirse en una restricción jurídica para aquellos incapacitados permanentes que deseen incorporarse al mercado laboral.
Taking into account the recognition of the Spanish Constitution, that we all have the right to work, this study has as its central axis to analyze the regulations, doctrine and jurisprudence that exist in this regard, with regard to the compatibility or incompatibility of pensions for permanent disability with paid work, either as an employee or as a self-employed person. The role of the National Institute of Social Security is fundamental, because it can become a legal restriction for those permanently disabled who wish to join the labor market.
