El derecho nómada : un paso hacia el derecho colectivo del trabajo desde el "rizoma" y la "multitud"

Abstract

Tratase de esbozar los virtuales senderos de los planteamientos más clásicos para el estudio del Derecho, desde algunas herramientas que suministra el pensamiento de corte postestructuralista, más específicamente las contribuciones de dos pares de pensadores contemporáneo, a saber, Gilles Deleuze & Félix Guattari, otrosí, Antonio Negri & Michael Hardt, los cuales, a su turno, tienen todos como marco de inspiración el filósofo holandés del siglo XVII, Baruch Spinoza. La propuesta es seguir las sendas suscitadas por la noción de Ordenamiento jurídico desde las ideas de "rizoma" y "multitud", conceptos formulados por los referidos autores. E, partir de ahí, examinar la implicación del modelo de Ordenamiento derivado de tales planteamientos en el campo del Derecho Colectivo del Trabajo, especialmente en relación a tres de sus institutos claves: la representación de trabajadores, la huelga y la negociación colectiva. No es objetivo de este estudio involucrarse en las especificidades dogmáticas de un Ordenamiento nacional específico, aunque el modelo español sea el modelo básico a que sirva de referencia al desarrollo de las ideas aquí delineadas. Lo que se propone es llevar a cabo una reflexión crítica sobre la tradición trascendente que suele informar los estudios respecto a los Derechos Fundamentales del Trabajo, forneciendo los rasgos principales y los mecanismos básicos que permitan pensar los institutos-clave del Derecho Colectivo, más allá de los supuestos clásico
