El presente estudio trata de mostrar, en primer lugar, el nuevo consenso alcanzado en torno a las complejas relaciones entre Justicia y Paz y el muy relevante papel que, en relación a las mismas, han comenzado a jugar las víctimas de crímenes internacionales; para, a partir de ahí, establecer el estatuto jurídico internacional de las víctimas de crímenes internacionales. Todo lo cual dibuja un nuevo marco jurídico internacional que, como se aborda en tercer lugar, debe ser respetado por Colombia en su ordenamiento jurídico interno y, dentro de éste, muy especialmente en los resultados de las negociaciones de los distintos procesos de paz que se han venido desarrollando en ese país sudamericano. Ello viene sin duda a limitar, si bien en ningún caso a eliminar, el, por otro lado necesario, margen de maniobra que los actores deben utilizar para alcanzar los equilibrios que hagan culminar dichos procesos en una paz con justicia en Colombia.

This paper shows, in first place, the new consensus reached on the complex relations between Justice and Peace and the very much important role played on it by victims of international crimes. From that basis, the international legal status of victims of international crimes will be studied, in second place. All that draws a new international legal framework that, as will be shown in third place, must be observed by Colombia’s internal law and, within it, especially in the results of the different peace process negotiations that are or have been in place in that South American country. No doubt that all this places legal limits on negotiating parties, even though in any case that means to deny the, on the other hand always necessary, dealing freedom that those negotiating parties should use to reach the always difficult balance that will allow them to attain a peace with justice in Colombia.
